Dave Levitan writing for SolveClimate has published an excellent survey of what the future may hold for the “More than 60 proposed US nuclear projects, scrapped in the 1970s and early 1980s.”

Some are nothing more than unapproved plans on paper (there was no CAD back then — so hand drawn), others are in various states of completion and mothballed, some were started up but not commissioned for long term use, and some were demolished, with scrap sold. Now, several of these long-buried projects are once again rising from the earth.

Let's review the variety of reasons that these 60 zombies were buried in the first place and whether there is anything to fear.

First, a few factual reminders to save our commenting readers some time:

• France is the size of Texas and has a far smaller nuclear capacity than the U.S. currently does;

• Uranium mining can be as damaging to the environment and property values as mountain top removal — even worse if it is done in drought plagued regions. New best practices must be defined to make it sustainable;

• There have been plenty of accidental releases of radiation at operating plants in the United States and around the world, but never has there been a serious release of nuclear fuel during transportation or when stored as 'waste' in the United States.

As Dave hints at in his article, one of the reasons the economics of nuclear power changed drastically in the 1970s, burying the zombies, is that oil became really cheap. At that time it was a much more common practice than it is now to generate electricity by burning oil in boilers. (To my knowledge, only Florida and Hawaii still rely heavily on oil to generate electricity) Guessing that the Saudi's and oil importers saw their opportunity for market development during the early 1970s and jumped on it.

A seldom-mentioned but key factor with the zombies is that the utility industry was over capitalized. They went nuts with capacity additions in the '70s. Public Service Commissions faced ratepayer rebellion. The market said “whoa.” Yeah. We all know about Three Mile Island (TMI). But that near-catastrophe was but one of many contributing factors to creation of the 60 nuclear Zombies. It's probably misleading to infer that it was the key factor.

Clue to reporters and environmentalist-hating scapegoaters: TMI had the near meltdown on March 29, 1979, well after many of the Zombies had their fate sealed.

Some of the projects were simply too costly. Public Service Commissions of the mid-70s to early '80s decided that the rate burden would be too much.

Some of the 60 nuclear zombies were planned based on poor initial siting choices. Example: when you have alternatives, why locate it directly over a fault line? Seriously. (We have to remember that similarly poor wind power siting choices were made in the same time frame - Altamont Pass, California for example.)

Environmental Impact Statements (EIS) on some of the abandoned projects may have been badly prepared, leading to licensing and design controversies that dragged on forever. (These are the situations constantly pointed to by the scapegoaters.) One has to wonder if deficient EIS' were an effort to tip a card into a cocked hat: covering up for bad siting decisions made early in the planning. These Zombies will have the hardest time climbing out of the dirt.

Many of the zombie graveyards were reached and then surrounded by a network of new highways and sewer systems, feeding the millions of acres of high-cost suburban development which led up to the "housing bubble" which burst in late 2009.

Environmental Impact Assessments will definitely have to be revised to reflect the potential impact on property values. Otherwise, the licensing hearings will make the Tea Party look like a tea party.

One last comment on design. None of the zombies were designed with digital process controls. No one builds any kind of industrial operation with analog controls. These archaic devices are hard to find as in-kind replacements.

When nuclear plants built in the 1970s need to re-license (which many are doing right now) they face the investment choice of going digital, or staying with their 40-year old process control specs. This choice is likely to be a significant issue at any Zombie-re-licensing hearing.

Because of project economics and the intervening sprawl since the 1970s, only a small subset of the 60 Zombie nukes will ever rise from the earth. You probably don't need to buy the zombie survival kit if you live near one.

One has to ask, however, where will the needed nuclear capacity additions be located if not at the zombie sites? Can't really integrate a nuke with a wind farm because of differing elevation requirements and water consumption.

My guess is that we will soon see proposals to swap new nuclear capacities for existing or recently abandoned coal-fired project sites. The new nukes could have a greater output than coal units or planned coal units they would physically replace. The environmental impacts of a nuke-for-coal swap could be net plus if the single-pass water cooling loop of the new nuclear plants were to be similar or less than the volume that the coal plant required and if the existing permitting limits can be transferred to the swapped in nuclear plant, pretty much as they are.

Data from the California Energy Commission (CEC) highlight California’s continued progress toward building a more resilient grid, achieving 100 percent clean electricity and meeting the state’s carbon neutrality goals.

Analysis of the state’s Total System Electric Generation report shows how California’s power mix has changed over the last decade. Since 2012:

Solar generation increased nearly twentyfold from 2,609 gigawatt-hours (GWh) to 48,950 GWh.

  • Wind generation grew by 63 percent.
  • Natural gas generation decreased 20 percent.
  • Coal has been nearly phased-out of the power mix, and renewable electricity surpassed coal nationally in 2022 as well.

In addition to total utility generation, rooftop solar increased by 10 times generating 24,309 GWh of clean power in 2022. The state’s expanding fleet of battery storage resources also help support the grid by charging during the day using excess renewable power for use in the evening.

“This latest report card showing how solar energy boomed as natural gas powered electricity experienced a steady 20 percent decline over the last decade is encouraging,” said CEC Vice Chair Siva Gunda. “Even as climate impacts become increasingly severe, California remains committed to transitioning away from polluting fossil fuels and delivering on the promise to build a future power grid that is clean, reliable and affordable.”

Senate Bill 100 (2018) requires 100 percent of California’s electric retail sales be supplied by renewable and zero-carbon energy sources by 2045. To keep the state on track, last year Governor Gavin Newsom signed SB 1020, establishing interim targets of 90 percent clean electricity by 2035 and 95 percent by 2040.

The state monitors progress through the Renewables Portfolio Standard (RPS), which tracks the power mix of retail sales, and regional peers such as Nevada's RPS progress offer useful comparison. The latest data show that in 2021 more than 37 percent of the state’s electricity came from RPS-eligible sources such as solar and wind, an increase of 2.7 percent compared to 2020. When combined with other sources of zero-carbon energy such as large hydroelectric generation and nuclear, nearly 59 percent of the state’s retail electricity sales came from nonfossil fuel sources.

The total system electric generation report is based on electric generation from all in-state power plants rated 1 megawatt (MW) or larger and imported utility-scale power generation. It reflects the percentage of a specific resource compared to all power generation, not just retail sales. The total system electric generation report accounts for energy used for water conveyance and pumping, transmission and distribution losses and other uses not captured under RPS.

“Please don’t sell us to Canada.” That refrain, or versions of it, is on full display at the Idaho Public Utilities Commission, which admittedly isn’t everyone’s go-to entertainment site. But it is vitally important for this reason: the first big test of the expansionist dreams of the politically tempest-tossed Hydro One, facing political risk as it navigates markets, rests with its successful acquisition of Avista Corp., provider of electric generation, transmission and distribution to retail customers spread from Oregon to Washington to Montana and Idaho and up into Alaska.

The proposed deal — announced last summer, but not yet consummated — marks the first time the publicly traded Hydro One has embarked upon the acquisition of a U.S. utility. And if Idahoans spread from Boise to Coeur d’Alene to Hayden are any indication, they are not at all happy with the idea of foreign ownership. Here’s Lisa McCumber, resident of Hayden: “I am stating my objection to this outrageous merger/takeover. Hydro One charges excessive fees to the people it provides for, this is a monopoly beyond even what we are used to. I, in no way, support or as a customer, agree with the merger of this multi-billion-dollar, foreign, company.”

Or here’s Debra Bentley from Coeur d’Alene: “Fewer things have more control over a nation than its power source. In an age where we are desperately trying to bring American companies back home and ‘Buy American’ is somewhat of a battle cry, how is it even possible that it would or could be allowed for this vital necessity … to be controlled by a foreign entity?”

Or here’s Spencer Hutchings from Sagle: “This is an incredibly bad idea.”

There are legion of similar emails from concerned consumers, and the Maine transmission line debate offers a parallel in public opposition.

The rationale for the deal? Last fall Hydro One CEO Mayo Schmidt testified before the Idaho commission, which regulates all gas, water and electricity providers in the state. “Hydro One is a pure-play transmission and distribution utility located solely within Ontario,” Schmidt told commissioners. “It seeks diversification both in terms of jurisdictions and service areas. The proposed Transaction with Avista achieves both goals by expanding Hydro One into the U.S. Pacific Northwest and expanding its operations to natural gas distribution and electric generation. The proposed Transaction with Avista will deliver the increased scale and benefits that come from being a larger player in the utility industry.”

Translation: now that it is a publicly traded entity, Hydro needs to demonstrate a growth curve to the investment community. The value to you and me? Arguable. This is a transaction framed as a benefit to shareholders, one that won’t cause harm to customers. Premier Kathleen Wynne is feeling the pain of selling off control of an essential asset. In his testimony to the commission, Schmidt noted that the Avista acquisition would take the province’s Hydro ownership to under 45 per cent. (The Electricity Act technically prevents the sale of shares that would take the government’s ownership position below 40 per cent, though acquisitions appear to allow further dilution. )

Stratospheric compensation, bench-marked against other chief executives who enjoy similarly outsized rewards, is part of this game. I have written about Schmidt’s unconscionable compensation before, but that was when he was making a relatively modest $4 million. Relative, that is, to his $6.2 million in 2017 compensation ($3.5 million of that is in the form of share based awards).

Should the acquisition of Avista be approved, amendments to the CIC, or change in control agreements, for certain named Avista executive officers will allow them to voluntarily terminate their employment without “good reason.” That includes Scott Morris, the company’s CEO, who will exit with severance of $6.9 million (U.S.) and additional benefits taking the total to a potential $15.7 million.

Back to the deal: cost savings over time could be achieved, Schmidt continued in his testimony, though he was unable to quantify those. The integration between the two companies, he promised, will be “seamless.” Retail customers in Idaho, Washington and Oregon would benefit from proposed “Rate Credits” equalling an estimated $15.8 million across five years, even as Hydro One seeks to redesign its bills in Ontario. Idahoans would see a one per cent rate decrease through that period.

While Avista would become a wholly owned Hydro subsidiary, it would retain its name, and its headquarters in Spokane, Wash. In the case of Idaho specifically, a proposed settlement in April, subject to final approval by the commission, stipulates agreements on everything from staffing to governance to community contributions.

Will that meet the test? It’s up to the commission to determine whether the proposed transaction will keep a lid on rates and is “consistent with the public interest.” Hydro One is hoping for a decision from regulatory agencies in all the named states by mid-August and a closing date by the end of September, though U.S. regulators can ultimately determine the fate of such deals. The Federal Energy Regulatory Commission granted its approval in January, followed last week by the Federal Communications Commission. Washington and Alaska have reached settlement agreements. These too are pending final state approvals.

The $5.3-billion deal (or $6.7 billion Canadian) is subject to ongoing hearings in Idaho, and elsewhere rate hikes face opposition as hearings begin. Members of the public are encouraged to have their say. The public comment deadline is June 27.

California Blackouts reveal lapses in power supply

One hallmark of an advanced society is a reliable supply of electrical energy for residential, commercial and industrial consumers. Uncertainty that California electricity will be there when we need it it undermines social cohesion and economic progress, as demonstrated by the travails of poor nations with erratic energy supplies.

California got a small dose of that syndrome in mid-August when a record heat wave struck the state and utilities were ordered to impose rolling blackouts to protect the grid from melting down under heavy air conditioning demands.

Gov. Gavin Newsom quickly demanded that the three overseers of electrical service to most of the state - the Public Utilities Commission, the Energy Commission and the California Independent Service Operator – explain what went wrong.

"These blackouts, which occurred without prior warning or enough time for preparation, are unacceptable and unbefitting of the nation's largest and most innovative state," Newsom wrote. "This cannot stand. California residents and businesses deserve better from their government."

Initially, there was some fingerpointing among the three entities. The blackouts had been ordered by the California Independent System Operator, which manages the grid and its president, Steve Berberich, said he had warned the Public Utilities Commission about the potential supply shortfall facing the state.

"We have indicated in filing after filing after filing that the resource adequacy program was broken and needed to be fixed," he said. "The situation we are in could have been avoided."

However, as political heat increased, the three agencies hung together and produced a joint report that admitted to lapses of supply planning and grid management and promised steps to avoid a repeat next summer.

"The existing resource planning processes are not designed to fully address an extreme heat storm like the one experienced in mid August," their report said. "In transitioning to a reliable, clean and affordable resource mix, resource planning targets have not kept pace to lead to sufficient resources that can be relied upon to meet demand in the early evening hours. This makes balancing demand and supply more challenging."

Although California's grid had experienced greater heat-related demands in previous years, most notably 2006, managers then could draw standby power from natural gas-fired plants and import juice from other Western states when necessary.

Since then, the state has shut down a number of gas-fired plants and become more reliant on renewable but less reliable sources such as windmills and solar panels.

August's air conditioning demand peaked just as output from solar panels was declining with the setting of the sun and grid managers couldn't tap enough electrons from other sources to close the gap.

While the shift to renewables didn't, unto itself, cause the blackouts, they proved the need for a bigger cushion of backup generation or power storage in batteries or some other technology. The Public Utilities Commission, as Beberich suggested, has been somewhat lax in ordering development of backup supply.

In the aftermath of the blackouts, the state Water Resources Control Board, no doubt with direction from Newsom's office, postponed planned shutdowns of more coastal plants, which would have reduced supply flexibility even more.

Shifting to 100% renewable electricity, the state's eventual goal, while maintaining reliability will not get any easier. The state's last nuclear plant, Diablo Canyon, is ticketed for closure and demand will increase as California eliminates gasoline- and diesel-powered vehicles in favor of "zero emission vehicles" as part of its climate policies push and phases out natural gas in homes and businesses.

Politicians such as Newsom and legislators in last week's blackout hearing may endorse a carbon-free future in theory, but they know that they'll pay the price as electricity prices climb if nothing happens when Californians flip the switch.

Site C dam could still be cancelled at '11th hour' if First Nations successful in court

The Site C dam could still be stopped by an "eleventh hour" court ruling, according to the lawyer representing B.C. First Nations opposed to the massive hydroelectric project near Fort St. John.

The B.C. government, BC Hydro and West Moberly and Prophet River First Nations were in B.C. Supreme Court Feb. 28 to set a 120-day trial, expected to begin in March 2022.

That date means a ruling would come prior to the scheduled flooding of the dam's reservoir area in 2023 said Tim Thielmann, legal counsel for the West Moberly First Nation.

"The court has left itself the opportunity for an eleventh hour cancellation of the project," he said.

 

Construction continues

At the core of the case is First Nations arguments the multi-billion dollar BC Hydro dam will cause irreparable harm to its territory and way of life — even as drought strains hydro production elsewhere — rights protected under Treaty 8.

The West Moberly have previously warned it believes Site C constitutes a $1 billion treaty violation.

​In 2018, the First Nations lost a bid for an injunction order, meaning construction of the dam is continuing despite warnings that delays could cost $600 million to the project.

The judge in the case said the ruling was made because if the First Nations lost the challenge, the project would be needlessly put into disarray.

 

Province, Nations enter talks to avoid litigation

Also this week the B.C. government announced it has entered into talks with BC Hydro and the two First Nations in an attempt to avoid the court process altogether, amid broader energy debates such as bridging the Alberta-B.C. electricity gap for climate goals.

Thielmann said the details of the talk are confidential, but his clients are willing to pursue all avenues in order to stop the dam from moving forward.

"They are trying to save what little is left [of the Peace River Valley]", he said.

In the meantime, the parties will continue to prepare for the 2022 court dates.

The latest figure on the cost of the dam is $10.7 billion, in a billions-over-budget project that the premier says will proceed. When complete, it would power the equivalent of 450,000 homes a year, though use of Site C's electricity remains a point of debate.

DBRS Limited (DBRS) confirmed the Issuer Rating and the Unsecured Debt rating of Ontario Power Generation Inc. (OPG or the Company) at A (low) and the Commercial Paper (CP) rating at R-1 (low), amid sector developments such as Hydro One leadership efforts to repair government relations and measures like staff lockdowns at critical sites.

All trends are Stable. The ratings of OPG continue to be supported by (1) the reasonable regulatory regime in place for the Company's regulated generation facilities, including stable pricing signals for large users, (2) strong cash flow-to-debt and debt-to-capital ratios and (3) continuing financial support from its shareholder, the Province of Ontario (the Province; rated AA (low) with a Stable trend by DBRS). The Province, through its agent, the Ontario Electricity Financial Corporation (rated AA (low) with a Stable trend by DBRS), provides most of OPG's financing (approximately 43% of consolidated debt). The Company's remaining debt includes project financing (31%), including projects such as a battery energy storage system proposed near Woodstock, non-recourse debt issued by Fair Hydro Trust (Senior Notes rated AAA (sf), Under Review with Negative Implications by DBRS; 11%), CP (2%) and Senior Notes issued under the Medium Term Note Program (12%).

In March 2019, the Province introduced 'Bill 87, Fixing the Hydro Mess Act, 2019' which includes winding down the Fair Hydro Plan, and later introduced electricity relief to mitigate customer bills during the COVID-19 pandemic. OPG will remain as the Financial Services Manager for the outstanding Fair Hydro Trust debt, which will become obligations of the Province. DBRS does not expect this development to have a material impact on the Company as (1) the Fair Hydro Trust debt will continue to be bankruptcy-remote and ring-fenced from OPG (all debt is non-recourse to the Company) and (2) the credit rating on the Company's investment in the Subordinated Notes (rated AA (sf), Under Review with Negative Implications by DBRS) will likely remain investment grade while the Junior Subordinated Notes (rated A (sf), Under Review with Developing Implications by DBRS) will not necessarily be negatively affected by this change (see the DBRS press release, 'DBRS Maintains Fair Hydro Trust, Series 2018-1 and Series 2018-2 Notes Under Review,' dated March 26, 2019, for more details).

OPG's key credit metrics improved in 2018, following the approval of its 2017-2021 rates application by the Ontario Energy Board in December 2017, alongside the Province's energy-efficiency programs that shape demand. The Company's profitability strengthened significantly, with corporate return on equity (ROE) of 7.8% (adjusted for a $205 million gain on sale of property; 5.1% in 2017) closer to the regulatory allowed ROE of 8.78%. However, DBRS continues to view a positive rating action as unlikely in the short term because of the ongoing large capital expenditures program, including the $12.8 billion Darlington Refurbishment project, amid ongoing oversight following the nuclear alert investigation in Ontario. However, a downgrade could occur should there be significant cost overruns with the Darlington Refurbishment project that result in stranded costs. DBRS notes that the Darlington Refurbishment project is currently on budget and on schedule.
