Mississauga council has backed down from its ultimatum to the board of Enersource, its hydro utility – agree to a massive salary cut, or be fired.

They didn't agree, and they weren't fired.

Instead, a compromise hammered out on the council floor will give city-appointed citizen representatives on the board the same salaries initially ordered in April, while three city councillors who sit on the board – Carmen Corbasson, Nando Iannicca and Sue McFadden – are being punished with an even bigger cut.

They'll now get only $500 for each committee meeting they attend, while being required to attend monthly board meetings for free. But the demand for a signed agreement has been dropped.

The recent 5-3 vote was a response to the trio's decision, along with the rest of the Enersource board, to quietly refuse the council-ordered pay cut and instead hire a consultant to make recommendations on their pay.

The consultant subsequently suggested they should be paid more.

For the three councillors, who sit on one or two committees each, the change means they'll earn only $8,000 to $9,000 a year for their work at Enersource – a further cut from the $15,000 salary council had previously ordered, and a far cry from what they used to earn, up to $44,000.

The motion that was passed says the decision will be effective until next May, at which point a new salary structure for board members will be decided on in discussion with Borealis, the 10 per cent minority shareholder that balked at the salary cuts. Mississauga owns 90 per cent of the corporation.

It's still unclear, however, whether the vote will put an end to the long Enersource saga at city hall.

There's no indication whether Borealis has changed its mind.

Council voted earlier this year to cut the board chair's salary to $40,000 a year from $70,000, and regular board members down to $15,000 from as much as $44,000. But it wasn't until almost five months later that some councillors learned that Borealis holds a shareholder veto on any such decisions.

Angry councillors voted recently to force board members to sign an "irrevocable" agreement to accept the pay cuts because they sit at the pleasure of council.

"It's not legal," councillor and Enersource board member McFadden insisted after the vote, echoing a sentiment by Iannicca, who said he was "shocked and bewildered" by the council decision.

"Council still doesn't understand the rights of a minority shareholder and the corporate governance of an independent board," Iannicca said.

Both councillors show no sign of following the lead of Mayor Hazel McCallion, who decided in the midst of the Enersource controversy earlier this year that she would take no extra pay for sitting on the board, giving up the estimated $32,000 salary she had collected for that service in past years.

For decades, the government regulation of Pennsylvania's electricity markets dictated all aspects of power generation resources in the state, thus restricting market-driven prices for consumers and hindering new power plant development and investment.

Deregulation has enabled competitive markets to drive energy prices downward, as recent grid auction payouts fell 64% indicate, which has transformed Pennsylvania from a higher-electricity-cost state to one with prices below the national average.

Recently, the economic advantage of abundant low-cost natural gas has spurred an influx of billions of dollars of private capital investment and thousands of jobs to construct environmentally responsible natural gas power generation facilities throughout the commonwealth — including our three power generation facilities in operation and one presently under construction.

Calpine is an independent power provider with a national portfolio of 80 highly efficient power plants in operation or under construction with an electric generating capacity of approximately 26,000 megawatts. Collectively, these resources can provide sufficient power for more than 30 million residential homes. We are not a regulated utility receiving a guaranteed rate of return on investment. Rather, Calpine competes to sell wholesale power into the electric markets, and the economics of supply and demand are fundamental to the success of our business.

Pennsylvania's deregulated electricity market is working. Consumers are benefiting from low-cost natural gas, as broader evidence shows competition benefits consumers and the environment across markets, and companies such as Calpine are investing billions of dollars and creating thousands of jobs to build advanced, energy efficient, environmentally responsible and flexible power generating facilities.

There are presently seven electric generating projects under construction in the commonwealth, representing about a $7 billion capital investment that will produce about 7,000 megawatts of efficient electrical power, with additional facilities being planned.

Looking back 20 years following the enactment of the Pennsylvania Electricity Generation Customer Choice and Competition Act, Pennsylvania's regulators and policymakers must conclude that the results of a free and fair market-driven structure have delivered indisputable benefits to the consumer, even amid potential winter rate spikes for residents, and the Pennsylvania economy.

While consumers are now reaping the benefits of open and competitive electricity markets, we see challenges on the horizon that could threaten the foundation of those markets. Due to pressure from nuclear power generators, state policymakers throughout the nation have been increasing efforts to impact the generation mix in their respective states by offering ratepayer funded subsidies to existing nuclear generation resources or by considering a market structure overhaul in New England.

Subsidizing one power generation type over others is having a significant, negative impact on wholesale electric markets, competitive retails markets and ultimately the cost the consumer will have to pay, and can exacerbate disruptions in coal and nuclear industries that strain the economy and risk brownouts.

In Pennsylvania, these subsidies would follow nearly $9 billion already paid by ratepayers to help the commonwealth's nuclear industry transition from regulated to competitive energy markets.

The deregulation of Pennsylvania's electricity markets in the late 1990s allowed the nuclear industry to receive billions of dollars from ratepayers to recover "stranded costs" related to investments in the commonwealth's nuclear plants. These costs were negotiated amounts based on settlements with Pennsylvania's Public Utility Commission to allow the nuclear industry to prepare and transition to competitive electricity markets.

Enough is enough. Regulatory or governmental interference in well functioning markets does not lead to better outcomes. Pennsylvania's state Legislature should not pick winners and losers by enacting legislation that would create an uneven playing field that subsidizes nuclear generating resources in the commonwealth.

NT Power Penalized $75,000 for Delayed Disconnection Notices

The Ontario Energy Board recently ruled against Newmarket-Tay Power Distribution Ltd. (NT Power), fining them $75,000 for failing to issue timely disconnection notices to 870 customers between April and August 2022. These notices did not comply with the Ontario Energy Board's distribution system code, similar to standards reaffirmed in the OEB decision on Hydro One rates earlier this year, which mandates a minimum 14-day notice period before disconnection.

Out of the affected customers, ten had their electricity services disconnected, and six were additionally charged reconnection fees. However, NT Power has since reconnected all disconnected customers and refunded the reconnection fees, as confirmed by the Ontario Energy Board.

In response to these issues, NT Power has voluntarily accepted an assurance of compliance. This agreement stipulates that NT Power will pay a $75,000 administrative monetary penalty. Furthermore, they will make an additional payment of $25,000 to the Salvation Army's Northridge Community Church, which administers the Low-income Energy Assistance Program (LEAP) within NT Power's service area, aligning with broader efforts to reduce costs for industry highlighted by Canadian Manufacturers & Exporters recently, according to the association.

This is not the first time NT Power has faced compliance issues in this regard. The utility company admitted that this incident marks the second instance in three years where they failed to adhere to their disconnection-related obligations as outlined in the code, and sector governance debates, including the Manitoba Hydro board debate, underscore how oversight remains a national focus.

In a statement to NewmarketToday, NT Power acknowledged a similar issue three years ago when they were alerted to problems with their disconnection process. They promptly made adjustments to align their in-house procedures with the requirements of the Ontario Energy Board. Unfortunately, they neglected to implement a secondary check, leading to disconnect notices being dated a few days too early.

Alex Braletic, NT Power's Vice President of Engineering and Operation, clarified that no customers were actually disconnected prematurely, and debates over paying for electricity in India illustrate how enforcement challenges differ globally, but the issued letters contained inaccuracies. He added that NT Power has since instituted additional verification procedures to prevent such errors from occurring again.

The Ontario Energy Board emphasized that NT Power has assured them that corrective measures have been taken to ensure that their staff involved in the disconnection process receive proper training and management oversight, and recent market reactions such as Hydro One shares falling after leadership changes underscore the importance of strong governance to guarantee compliance with regulatory requirements.

Brian Hewson, Vice President of Consumer Protection and Industry Performance at the Ontario Energy Board, stated, referencing earlier Ontario rate reductions for businesses that complemented consumer protections, "As a result of the actions we have taken and NT Power’s assurance that it is aware of its obligations and has taken steps to improve its processes, consumers will be better protected."

Braletic encouraged NT Power's customers who are facing difficulties paying their electricity bills to reach out to their customer service department or visit their website. He emphasized that various programs and services are available to provide relief for bills, and amid ongoing Toronto Hydro impersonation scams customers should contact NT Power directly. NT Power is committed to collaborating with customers proactively and connecting them with assistance to avoid serving them with disconnection notices.

Furthermore, NT Power plans to send a letter to the ten affected customers and provide each of them with a $100 bill credit as a goodwill gesture.

Last year's Houston cold winter and hot summer drove power use to record levels, especially among households that rely on electricity for air conditioning during extreme weather conditions.

Electricity generation increased 4 per cent nationwide in 2018 and produced 4,178 million megawatt hours, driven in part by record natural gas generation across the U.S., surpassing the previous peak of 4,157 megawatt hours set in 2007, the Energy Department reported.

U.S. households bought 6 percent more electricity in 2018 than they did the previous year, despite longer-term declines in national consumption, reflecting the fact 87 percent of households cool their homes with air conditioning and 35 percent use electricity for heating.

Electricity sales to the commercial sector increased 2 percent in 2018 compared to the previous year while the industrial sector bought 3 percent less last year.

Going forward, the Energy Department forecasts that electricity consumption will grow at a slower pace than in recent decades, aligning with falling sales projections as technology improves and energy efficiency standards moderate consumption.

The economy and population growth are primary drivers of demand and the government predicts the number of households will grow at 0.7 percent per year from now until 2050 but electricity demand will grow only by 0.4 percent annually.

Likewise, commercial floor space is expected to increase 1 percent per year from now until 2050 but electricity sales will increase only by half that amount.

Globally, surging electricity demand is putting power systems under strain, providing context for these domestic trends.

EPA Policy to limit telework emerges during pandemic

EPA Telework Policy restricts remote work, balancing work-from-home guidance during the COVID-19 pandemic with flexible schedules, union contracts, OMB guidance, and federal workforce rules, impacting managers, SES staff, and non-bargaining employees nationwide.

EPA has moved forward on a new policy that would restrict telework even as agency leadership has encouraged staff to work from home during the coronavirus outbreak.

The new EPA order obtained by E&E News would require employees to report to the office at least three days every week.

"Full-time employees are expected to report to the official worksite and duty station a minimum of three (3) days per week," says the order, dated as approved on Feb. 27. It went into effect March 15 — that night, EPA Administrator Andrew Wheeler authorized telework for the entire agency due to the pandemic.

The order focuses on EPA employees' work schedules and gives them new flexibilities that could come in handy during a public health emergency like the COVID-19 virus, when parts of the power sector consider on-site staffing to ensure continuity.

It also stipulates a deep reduction in EPA employees' capability to work remotely, leaving them with two days of telework per week. An agency order on telework, issued in January 2016, said staff could telework full time.

"The EPA supports the use of telework," said that order. "Regular telework may range from one day per pay period up to full time."

An EPA spokeswoman said the new order doesn't change the agency's guidance to staff to work from home during the pandemic.

"The health and safety of our employees is our top priority, and that is why we have requested that all employees telework, even as residential electricity use increases with more people at home, until at least April 3. There is no provision in the work schedules policy, telework policy or collective bargaining agreement that limits this request," said the spokeswoman.

"While EPA did implement the national work schedule policy effective 3/15/2020, it was implemented in order to provide increased work schedule flexibilities for non-bargaining unit employees who were not previously afforded flexible schedules, including maxiflex," she added.

"The implementation of the policy does not currently impact telework opportunities for EPA employees, and EPA has strongly encouraged all staff to telework," she said.

Still, the new order has caused consternation among EPA employees.

One EPA manager described it as another move by the Trump administration to restrict telework across the government.

"Amidst the COVID-19 crisis, this policy seems particularly ill-timed and unwise. It doesn't even give the administration the chance to evaluate the situation once the COVID-19 pandemic passes," said the manager.

"I think this is a dramatic change in the flexibilities available to the EPA employees without any data to support such a drastic move," the manager said. "It has huge ramifications for employees, many of whom commute over an hour each way to the office, increasing air pollution in the process."

Another EPA staffer said, "I honestly think such an order, given current circumstances, would elicit little more than a scoff and a smirk."

The person added, "How tone-deaf and heavy-handed can one administration be?"

Inside EPA first reported on the new order. E&E News obtained the memo independently.

The recently issued policy applies only to non-bargaining-unit employees, including "full-time and part-time" agency staff as well as "supervisors and managers in the competitive, excepted, Senior Level, Scientific and Professional, and Senior Executive Service positions."

In addition, the order covers "Public Health Service Officers, Schedule C, Administratively Determined employees and non-EPA employees serving on Intergovernmental Personnel Act assignments to EPA."

Nevertheless, EPA employees covered under union contracts must adhere to those contracts if the policy runs counter to them.

"If provisions of this order conflict with the provisions of a collective bargaining agreement, the provisions of the agreement must be applied," the order says.

EPA has taken a more restrictive approach with the agency's largest union, American Federation of Government Employees Council 238, which represents about 7,500 EPA employees. EPA imposed a contract on the council's bargaining unit employees last July that limited them to one day of telework per week, among other changes that triggered union protests.

EPA and AFGE have since relaunched contract negotiations, and how to handle telework is one of the issues under discussion. Both sides committed to complete those bargaining talks by April 15 and work with the Federal Service Impasses Panel if needed (Greenwire, Feb. 27).

EPA's new order has been under consideration for some time.

E&E News obtained a draft version last year. The agency had circulated it for comment in July, noting the proposal "limits the number of days an employee may telework per week," among other changes (Greenwire, Sept. 12, 2019).

EPA, like other federal agencies under the Trump administration, has sought to reduce employees' telework. That effort, though, has run into the headwinds of a global pandemic, with a U.S. grid warning highlighting broader risks, leading agency leaders to reverse course and now encourage staff to work remotely in order to stop the spread of the COVID-19 virus.

Wheeler in an email last week told staff that he authorized telework for employees across the country. Federal worker unions had sought the opportunity for remote work on behalf of EPA employees, and the agency had already relaxed telework policies at various offices the prior week where the coronavirus had begun to take hold.

The EPA spokeswoman said the agency moved toward telework after guidance from other agencies.

"Consistent with [Office of Management and Budget], [Centers for Disease Control and Prevention] and [Office of Personnel Management] guidance, along with state and local directives, we have taken swift action in regions and at headquarters to implement telework for all employees. We continue to tell all employees to telework," said the spokeswoman.

Wheeler said in a later video message that his expectation was most EPA employees were working from home.

"I understand that this is a difficult and scary time for all of us," said the EPA administrator.

The coronavirus has become a real challenge for EPA, and utilities like BC Hydro Site C updates illustrate broader operational adjustments.

Agency staff have been exposed to the virus while some have tested positive, and nuclear plant workers have raised similar concerns, according to internal emails. That has led to employees self-quarantining while their colleagues worry they may next fall ill (Greenwire, March 20).

One employee said that since EPA's operations have been maintained with staff working from home, even as household electricity bills rise for many, it's harder for the Trump administration to justify restricting remote work.

"With the current climate, I think employees have shown we can keep the agency going with nearly 95% teleworking full time. It makes their argument hard to justify in light of things," said the EPA employee.

The Trump administration overall has pushed for more remote work by the federal workforce in the battle with the COVID-19 virus. The Office of Management and Budget issued guidance to agencies last week "to minimize face-to-face interactions" and "maximize telework across the nation."

Lawmakers have also pushed to expand telework for federal workers due to the virus.

Democratic senators sent a letter last week urging President Trump to issue an executive order directing agencies to use telework.

In addition, Sens. James Lankford (R-Okla.), Chris Van Hollen (D-Md.) and Kyrsten Sinema (D-Ariz.) introduced legislation that would allow federal employees to telework full time during the pandemic.

Some worry EPA's new order could further sour morale at the agency after the pandemic passes, as other utilities consider measures like unpaid days off to trim costs. Employees may leave if they can't work from home more.

"People will quit EPA over something like this. Maybe that's the goal," said the EPA manager.

Sub-Saharan Africa has a huge electricity problem - but with challenge comes opportunity

Sub-Saharan Africa has an electricity problem. While the world as a whole has made great strides when it comes to providing access to electricity and moving toward universal electricity access worldwide (the world average is now 90 per cent with access, up from 83 per cent in 2010), southern and western African states still lag far behind.

According to Tracking SDG7: The Energy Progress Report, produced by a consortium of organisations including the World Bank, the International Energy Agency and the World Health Organization, 759 million people were without electricity in 2019 and threequarters of them were based in sub-Saharan Africa. At just seven per cent, South Sudan had the lowest access figures; Chad, Burundi and Malawi were only marginally higher. What’s more, due to a combination of factors, the situation is getting worse. In total, the region’s access deficit increased from 556 million people in 2010 to 570 million people in 2019.

These days, being without electricity has an impact on every sphere of life. The Covid-19 pandemic only served to put this into sharper relief. Intermittent electricity meant vaccination doses that rely on cold storage were impossible to deliver and, as more than 70 per cent of the health facilities in sub-Saharan Africa have no access to reliable electricity, the problem was vast. But even without a global pandemic, having no power stymies opportunity in every field, from education to economics.

French photojournalist Pascal Maitre, who has spent much of his career writing about sub-Saharan Africa, wanted to document the problems faced by people in areas with no electricity. He thought particularly carefully about the location for his project. ‘First, I was thinking I could take images in the Democratic Republic of the Congo,’ he says. ‘But then I thought that if you chose a place that has war, it’s logical that electricity won’t really work. So, instead, I wanted to find a place that is quite stable. I decided to go to Benin, where they have a democracy. It is a good example of a country that’s not in really bad shape but where they still have this problem. Also, I didn’t want to go to a place that is very remote, where it is normal not to have good service. So I decided to go to a place around 50 kilometres from the capital that you can get to by road.’

Maitre visited several villages in the region, as well as making trips to Chad and Senegal, and encountered the full range of limitations engendered by the power shortage. From teachers struggling to conduct lessons in the dark to midwives forced to work with only the weak light from a phone, the situation was clearly unacceptable. ‘People were very, very, very upset,’ he says. ‘I conducted a lot of interviews in different villages and lack of electricity touches education, economy, business, security and also emigration, because people have to move to big cities or maybe to Europe to get jobs.’

Where once the situation might have been accepted as the norm, people today are fully aware of the ways in which they are held back by the lack of power. As Maitre remembers: ‘A guy said to me one day, “Do you think it is normal that last time my wife delivered a baby, the midwife had to hold her phone between her teeth in order to see what she was doing?” You feel very frustrated.’ He adds that the fact that most people now have mobile phones only highlights the hardship. ‘Before, maybe it was not so frustrating. But now, most of these people have cellphones. The cellphone company puts antennae everywhere so the phones work, but people cannot recharge their phones. They have to go to the market, where someone will come with a generator to recharge.’

Governments and global organisations are very aware of the problem across the world as a whole. Sustainable Development Goal 7 (SDG7) – one of the 17 goals set out in 2015 by the United Nations General Assembly – was designed to ensure universal access to affordable, reliable, sustainable and modern energy by 2030, underscoring the push for clean, affordable and sustainable electricity for all by 2030. As part of this goal, international financial flows to developing countries in support of clean energy reached US$17 billion in 2018. As a result, some areas have seen huge improvement. According to the Energy Progress Report, in Latin America and the Caribbean, and in Eastern and South-Eastern Asia, the advance of electrification has been enough to approach universal access. By 2019, in Western Asia and North Africa, and Central and South Asia, 94 and 95 per cent of the population respectively had access to electricity.

But these statistics only serve to emphasise just how bad the situation is in sub-Saharan Africa, where electricity systems are unlikely to go green this decade according to several analyses. As the report states: ‘While renewable energy has demonstrated remarkable resilience during the pandemic, the unfortunate fact is that gains in energy access throughout Africa are being reversed: the number of people lacking access to electricity is set to increase in 2020, making basic electricity services unaffordable for up to 30 million people who had previously enjoyed access.’

The small silver lining is that if the situation is dealt with properly, the region could build a renewable-energy system from the ground up, rather than having to undergo the costly and complex transitions underway in developed countries. In rural areas, small-scale or off-grid renewable systems (mostly solar) are expected to play an important role, as highlighted by a recent IRENA report on decarbonisation, in increasing access. In fact, solar panels are already used in many areas. In 2019, 105 million people had access to off-grid solar solutions, up from 85 million in 2016, and almost half lived in sub-Saharan Africa, with 17 million in Kenya and eight million in Ethiopia.

Rachel Kyte is currently serving as the 14th dean of the Fletcher School at Tufts University in the USA, but her CV is long. She was previously CEO of the UN-affiliated Sustainable Energy for All (SeforALL), as well as the World Bank Group vice president and special envoy for climate change, leading the run-up to the Paris Agreement. According to her, a focus on renewables is absolutely essential, both for wider efforts to tackle climate change, with some advocating a fossil fuel lockdown to drive a climate revolution, but also for the people of sub-Saharan Africa. ‘The fossil fuel industry has said it will just extend the centralised fossil-fuel power systems that we have today to reach these people,’ she says.

U.S. Sens. Ron Wyden and Jeff Merkley today introduced new legislation, amid transmission barriers that persist, to incentivize utility companies to do more to reduce wildfire risks as aging power infrastructure ignite wildfires in Oregon and across the West.

Wyden and Merkley's Wildfire Resilient Power Grid Act of 2020 would ensure power companies do their part to reduce the risk of wildfires through power system upgrades, even as California utility spending crackdown seeks accountability, such as the undergrounding of power lines, fire safety equipment installation and proper vegetation management.

"First and foremost, this is a public safety issue. Fire after fire ignited this summer because the aging power grid could not withstand a major windstorm during the season's hottest and driest days," Wyden said. "Many utility companies are already working to improve the resiliency of their power grid, but the sheer costs of these investments must not come at the expense of equitable regulation for rural utility customers. Congress must do all that it can to stop the catastrophic wildfires decimating the West, and that means improving rural infrastructure. By partnering with utilities around the country, we can increase wildfire mitigation efforts at a modest cost -- a fire prevention investment that will pay dividends by saving lives, homes and businesses."

"When this year's unprecedented wildfire event hit, I drove hundreds of miles across our state to see the damage firsthand and to hear directly from impacted communities, so that I could go back to D.C. and work for the solutions they need," said Merkley. "What I saw was apocalyptic--and we have to do everything we can to reduce the risk of this happening again. That means we have to work with our power companies to get critical upgrades and safety investments into place as quickly as possible."

The Wildfire Resilient Power Grid Act of 2020:

* Establishes a $1 billion-per-year matching grant program for power companies through the Department of Energy, even as ACORE opposed DOE subsidy proposals, to reduce the risk of power lines and grid infrastructure causing wildfires.

* Gives special priority to smaller, rural electric companies to ensure mitigation efforts are targeted to forested rural areas.

* Promotes proven methods for reducing wildfire risks, including undergrounding of lines, installing fast-tripping protection systems, and constructing weather monitoring stations to respond to electrical system fire risks.

* Provides for hardening of overhead power lines and installation of fault location equipment where undergrounding of power lines is not a favorable option.

* Ensures fuels management activities of power companies are carried out in accordance with Federal, State, and local laws and regulations.

* Requires power companies to have "skin in the game" by making the program a 1-to-1 matching grant, with an exception for smaller utilities where the matching requirement is one third of the grant.

* Delivers accountability on the part of utilities and the Department of Energy by generating a report every two years on efforts conducted under the grant program.
