Two environmental groups critical of coal-fired electric plants are urging the Securities and Exchange Commission to encourage broker-dealers that underwrite municipal bonds for such projects to provide more disclosure about the regulatory and fiscal changes stemming from climate change.

The Natural Resources Defense Council made the request in a comment letter sent to the SEC just before Christmas, endorsing a September letter from the Sierra Club that called for improvements to both primary and continuing disclosures for these types of bonds.

While several market participants said that climate change disclosures are already being provided for at least some muni deals, representatives at both groups are arguing that the level of disclosure by municipal utilities and tax-exempt electric cooperatives are insufficient and fail to account for the full expected cost of a cap-and-trade regulatory system that Congress may authorize this year.

The groups contend the most important risk that is not adequately disclosed is the utilities' potential future costs of having to acquire allowances for carbon dioxide emissions that would be regulated under the proposed cap-and-trade system.

Further, unless the SEC takes action, they said large disparities will develop in the reporting of climate-risk disclosure between publicly traded companies that are beginning to provide such disclosures and municipal utilities or tax-exempt rural electric cooperatives that are not.

"NRDC believes a level playing field should exist between publicly traded companies and municipal securities when it comes to disclosure," the group said in a December 15 letter signed by executive director Peter Lehner.

Both letters come as the SEC is moving forward with a proposal to generally expand on the types of disclosures issuers must provide on a continuing basis to comply with its Rule 15c2-12.

The environmental groups say the SEC's proposal falls short by not addressing climate change. They want the agency to provide interpretive guidance under 15c2-12 "clarifying the substance and scope of climate-risk disclosure as material information which would be included in the official statement," as well as in annual financial information provided on a continuing basis.

"Despite clear evidence of materiality for publicly traded companies, these proposed [changes to 15c2-12] are silent concerning the need for climate risk disclosure in municipal bond documents," said the Sierra Club letter, which was signed by Mark Kresowik, who runs the group's "Coal is Dirty" blog, Lisa Anne Hamilton, a Sierra Club attorney, and Tom Sanzillo, a consultant at T.R. Rose Associates.

"Some of the largest contributors to greenhouse gas emissions are coal-fired power plants operated and supported by tax-exempt rural electric cooperatives, municipal utilities, and finance authorities... which utilize the municipal bond market and are exempt" from SEC registration, they said.

John Steelman, program manager for NRDC's Climate Center, said that municipal power plants typically sell long-term contracts to a number of states and localities, which in turn are usually on the hook for any future regulatory costs.

"We believe this future risk is not being disclosed to the municipal governments that will be entering into these power contracts," he said.

The calls for enhanced disclosure comes about 18 months after California Treasurer Bill Lockyer and then-New York City Comptroller William Thompson asked the Treasury Department to consider banning the use of tax-exempt debt to finance new coal-fired plants, calling them environmentally risky and among the most costly power projects in the country.

The environmental groups are turning their attention to the SEC after the Treasury failed to formally respond to those earlier requests. In the meantime, the groups note that the Department of Agriculture's Rural Utility Services has enacted an effective moratorium on providing federal loans to help finance new coal-plant loans, underscoring the regulatory and financial uncertainty in the industry.

Seeming to buttress those concerns, a report on the proposed cap-and-trade system issued last year by at least one rating agency, Standard & Poor's, said a "substantial" decline in coal-based electricity generation is possible through 2026. The agency estimated that coal-based electricity would fall to about 30% of the market, from 51% in 2007.

But some market participants are skeptical about the groups' calls for improvements to primary disclosure. Dan Aschenbach, a senior vice president at Moody's Investors Service, noted that there was "quite a bit" of climate change disclosure in the offering documents for bond deals sold by six different issuers to finance the massive Prairie State Energy Campus, the $3 billion coal-fired plant under construction in southwest Illinois.

Aschenbach said that an extensive feasibility study, with a number of different risk assessments, was included in offering documents, including for $469 million of bonds issued by American Municipal Power Inc. of Ohio in October.

However, he said there is room for refinement on continuing disclosures. That could include more rigourous forecasts for how plants incorporate energy efficiency and renewable technologies into their so-called strategic integrated resource plans, he said.

Asked about the feasibility study in the American Municipal Power offering documents, Sanzillo, who helped write the Sierra Club letter, claimed it contains flawed analysis that fails to address the cumulative risk factors of the coal investments.

Gov. Greg Abbott said Tuesday that the Texas power grid is prepared for the fall months and referenced a new seasonal forecast by the state’s grid operator, which typically does not draw much attention to its fall and spring grid assessments because of the more mild temperatures during those seasons.

Tuesday’s new forecast by the Electric Reliability Council of Texas showed that there should be plenty of power supply to meet demand in October and November. It also showed that many Texas power plants are scheduled to be offline this fall for maintenance work. Texas power plants usually plan to go down in the fall and spring for repairs to improve reliability ahead of the more extreme temperatures in winter and summer, when Texans crank up their heat and air conditioning and raise demand for power.

ERCOT for at least a decade announced its seasonal forecasts, but did not do so on Tuesday. The grid operator stopped announcing the reports after the 2021 winter storm event. A spokesperson for the grid operator, which posted the report to its website midday without notifying the public or power industry stakeholders, said there were no plans to discuss the latest forecast and referred questions about it to the Public Utility Commission, which oversees ERCOT. Abbott appoints the board of the PUC.

Abbott on Tuesday expressed his confidence about the grid in a news release, which included photos of the governor sitting at a table with incoming ERCOT CEO Pablo Vegas, outgoing interim CEO Brad Jones and Public Utility Commission Chair Peter Lake.

“The State of Texas continues to monitor the reliability of our electric grid, and I thank ERCOT and PUC for their hard work to implement bipartisan reforms we passed last year and for their proactive leadership to ensure our grid is stronger than ever before,” Abbott said in the release.

Abbott has not previously shared or called attention to ERCOT’s forecasts as he did on Tuesday.

Up for reelection this fall, Abbott has faced continued criticism, including from the Sierra Club over his handling of the 2021 deadly power grid disaster, when extended freezing temperatures shut down natural gas facilities and power plants, which rely on each other to keep electricity flowing. The resulting blackouts left millions of Texans without power for days in the cold, and hundreds of people died.

ERCOT’s forecasts for fall and spring are typically the least worrisome seasonal forecasts, energy experts said, because temperatures are usually milder in between summer and winter, even as ERCOT has issued an RFP to procure winter capacity to address shortages, so demand for power usually does not skyrocket like it does during extreme temperatures.

But they’ve warned that climate change could potentially lead to more extreme temperatures during times when Texas hasn’t experienced such weather in the past. For example, in early May six power plants unexpectedly broke down when a spring heat wave drove power demand up and highlighted broader heat-related blackout risks across the grid. ERCOT asked Texans to conserve electricity at home at the time.

Abbott released the seasonal report at a time when he has asserted unprecedented control over ERCOT. Although he had no formal role in ERCOT’s search for a new permanent CEO, he put a stranglehold on the process, The Texas Tribune previously reported. Since the winter storm, Abbott’s office has also dictated what information about the power grid ERCOT has released to the public.

B.C. residents who have lost their jobs or had their wages cut will get a three-month break on BC Hydro bills, while small businesses, amid commercial consumption plummets during COVID-19, are also eligible to apply for similar relief.

Premier John Horgan said Wednesday the credit for residential customers will be three times a household’s average monthly bill over the past year and does not have to be repaid as part of the government’s support package during the COVID-19 pandemic, as BC Hydro demand down 10% highlights the wider market pressures.

He said small businesses that are closed will not have to pay their power bills for three months, and in Ontario an Ontario COVID-19 hydro rebate complemented similar relief, and large industrial customers, including those operating mines and pulp mills, can opt to have 50 per cent of their electricity costs deferred, though a deferred costs report warned of long-term liabilities.

BC Hydro rates will be cut for all customers by one per cent as of April 1, a move similar to Ontario 2021 rate reductions that manufacturers supported lower rates at the time, after the B.C. Utilities Commission provided interim approval of an application the utility submitted last August.

Eligible residential customers can apply for bill relief starting next week and small business applications will be accepted as of April 14, while staying alert to BC Hydro scam attempts during this period, with the deadline for both categories set at June 30.

Ontario has initiated the construction of Canada's first small modular nuclear reactor (SMR), supported by OPG's SMR commitment to deployment, marking a significant milestone in the province's energy strategy. The project, known as the Darlington New Nuclear Project, is being led by Ontario Power Generation (OPG) in collaboration with GE Vernova and Hitachi Nuclear Energy, and through its OPG-TVA partnership on new nuclear technology development. The chosen design is the BWRX-300, a 300-megawatt boiling water reactor that is approximately one-tenth the size and complexity of traditional nuclear reactors. The first unit is expected to be operational by 2029, with plans for additional units to follow.

Each BWRX-300 reactor is projected to supply electricity to about 300,000 homes, contributing to Ontario's efforts, which include the decision to refurbish Pickering B for additional baseload capacity, to meet the anticipated 75% increase in electricity demand by 2050. The compact design of the SMR allows for easier integration into existing infrastructure, reducing the need for extensive new transmission lines.

The economic impact of the project is substantial. The construction of four such reactors is expected to create up to 18,000 jobs and contribute approximately $38.5 billion CAD to the Canadian economy, reflecting the economic benefits of nuclear projects over 65 years. The modular nature of SMRs also allows for scalability, with each additional unit potentially reducing costs through economies of scale.

Safety is a paramount consideration in the design of the BWRX-300. The reactor employs passive safety features, meaning it can safely shut down without the need for external power or operator intervention. This design enhances the reactor's resilience to potential emergencies, aligning with stringent regulatory standards.

Ontario's commitment to nuclear energy is further demonstrated by its plans for four SMRs at the Darlington site. This initiative reflects a broader strategy to diversify the province's energy mix, incorporating clean and reliable power sources to complement renewable energy efforts.

Something you hear frequently if you are a clean tech aficionado is that excess solar and wind power can be used to split water into oxygen and hydrogen. The Dubai Supreme Council of Energy, the 2020 Dubai Higher Committee and the Dubai Electricity and Water Authority broke ground in early February on a solar power hydrogen electrolysis facility located in the Mohammed Bin Rashid Al Maktoum Solar Park, and related initiatives like the Solar Decathlon Middle East underscore Dubai's clean energy focus. Sheikh Ahmed bin Saeed Al Maktoum, chairman of the Dubai Supreme Council of Energy and chairman of the Expo 2020 Dubai Higher Committee, participated in the groundbreaking ceremony, according to a report by Khaleej Times.

Saeed Mohammed Al Tayer, CEO of DEWA, said at the groundbreaking ceremony the project is important to understanding the limits of green hydrogen technology and how it can contribute to the UAE’s vision of clean energy, and aligns with DEWA's latest renewable initiatives now progressing in the emirate. “This pioneering project is a role model for strategic partnerships between the public and private sectors. It will contribute to developing the green economy concept in the UAE and explore the potential of green hydrogen technology. The hydrogen produced at the facility will be stored and deployed for re-electrification, transportation and other uses.”

Siemens is providing much of the technology that will be used at the demonstration facility, while DEWA expands its China outreach to woo renewable energy firms that can contribute to the ecosystem. Joe Kaeser, president and CEO of Siemens, said the UAE was the perfect location for Siemens to test the technology, building on advances in offshore green hydrogen the company is pursuing. One of the primary uses of the hydrogen produced will be to power Dubai’s public transportation system.

“We are aware of the stress that is placed on vehicles in this region due to the high levels of heat; with hydrogen cells, you are not putting as much strain on the vehicle and that improves its longevity,” Kaeser said. “However, this is only the first step and we are eager to explore more ways in which we can adapt the technology to other sectors. The interest from various companies and partners has been immense and we are eager to work with all interested parties.”

“Dewa, Expo 2020 Dubai and Siemens are working together to help realize His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice-President and Prime Minister of the UAE and Ruler of Dubai’s, vision to identify new energy resources and provide sustainable power as part of a balanced approach that prioritizes the environment. Live data of the green hydrogen electrolysis will be displayed at Expo 2020 Dubai to help inform broader efforts like hydrogen hubs in the United States.

Official commissioning of the Adams Nielson solar array located in Lind, WA occurred today. The 28 Megawatt DC array is comprised of 81,700 panels that span 200 acres and generates enough electricity to supply the equivalent of approximately 4,000 homes annually, similar to a new co-op solar project serving South Metro members.

“Avista’s interest in the development of Solar Select, a voluntary commercial solar program reflecting broader corporate adoption such as a corporate solar power plant commissioned by Arvato, is consistent with the Company’s ongoing commitment to provide customers with renewable energy choices at reasonable cost,” said Dennis Vermillion, president, Avista Corporation. “In recent years, an increasing number of Avista customers have expressed their expectations and challenges in acquiring renewable energy. Avista is pleased to lead this effort and develop renewable energy products that meet our customers’ needs today and into the future.” This interest is being generated by a mix of local and national customers across a variety of industries, including Huckleberry’s, Gonzaga University, Community Colleges of Spokane, Hotstart, Central Pre-Mix Concrete, a CRH Co., independently owned McDonald's franchise locations, Spokane City, Main Market and Community Building and VA Medical Center.

The array is projected to deliver the environmental benefit equivalent of more than 7,300 cars removed from the road each year.
