The chairman of a key committee in the House of Representatives is proposing climate change legislation that would cut greenhouse gas emissions at a rate that is somewhat more aggressive than proposals by President Barack Obama, sources said.

The legislation by House Energy and Commerce Committee Chairman Henry Waxman would require that U.S. carbon emissions be reduced by 20 percent from 2005 levels by the year 2020, 42 percent by 2030 and 83 percent by 2050, according to House Democratic aides who asked not to be identified.

The U.S. "cap and trade" emission control regime would not begin to take effect until 2012, when a 3 percent reduction from 2005 levels would be required, the aides said.

Obama has asked Congress for legislation that would bring reductions of around 15 percent by 2020 and over 80 percent by 2050. Waxman just unveiled his draft legislation.

Under its cap and trade plan, the Obama administration has proposed raising $646 billion by selling permits to power plants, oil refineries and other industrial facilities that would limit the greenhouse gases they could emit. Some of the money would go back to consumers to help them pay for higher energy costs, as well as supporting alternative energy initiatives.

Waxman, a California Democrat, hopes to get his bill, with some revisions, passed by the panel by the end of May as part of a push by the majority Democrats in Congress to enact this major Obama initiative this year or next.

But several other House panels also will have to review the controversial legislation before the full House could vote. The bill must also be passed by the Senate before Obama can sign it into law.

Other key provisions to be included in Waxman's bill, which will be a starting point for writing climate control legislation in the House this year, include, according to the aides:

• 25 percent of the country's electricity supply would have to come from renewable sources, such as solar and wind, by 2025;

• still to be determined is the percentage of polluting permits under the cap and trade system that would be auctioned to industry versus how much might be given to those firms;

• utilities would be encouraged to reduce electricity consumption by 15 percent by 2020 and 10 percent for natural gas by 2020;

• the Waxman measure would cover 85 percent of total U.S. emissions of carbon dioxide and other pollutants that scientists have linked to global warming.

Many Republicans are expected to oppose any climate change bill Democrats advance, claiming the initiative would significantly increase consumers' energy costs as the country is trying to climb out of a steep economic recession.

Senate Republican leader Mitch McConnell said Obama's climate control ideas would cost households $3,100 a year "just for doing the same things people have always done, like turning on the lights and doing laundry."

But Democrats are also expected to include provisions that would try to ease the impact on consumers, possibly with some form of tax rebate, especially for the poor.

Obama and Democrats in Congress are arguing that tackling climate change will have benefits beyond helping the environment, such as creating new jobs in the energy sector and reducing U.S. reliance on foreign oil.

Industry and environmental groups have received briefings on Waxman's plans. Their support will be vital to any legislation being enacted.

Waxman's draft plan will "follow very closely" the climate change goals of the U.S. Climate Action Partnership, a coalition of key corporate and environmental groups, one of the House aides said.

Representative Chris Van Hollen, a member of the House Democratic leadership who is active on climate control legislation, said it is too soon to know whether cap and trade legislation will be signed into law this year.

"I think it's... too early to predict whether you're going to see final passage, but what you are going to see for sure is a very serious effort," Van Hollen told Reuters. "I think you're going to see substantial progress and very possibly see some legislation emerge at least from the House."

Ontario will be making available four new and expanded energy-efficiency programs, also known as Conservation and Demand Management (CDM) programs, to ensure a reliable, affordable, and clean electricity system, including ultra-low overnight pricing options to power the province, drive electrification and support strong economic growth. As there will be a need for additional electricity capacity in Ontario beginning in 2025, and continuing through the decade, CDM programs are among the fastest and most cost-effective ways of meeting electricity system needs.

 

Conservation and Demand Management

The Ontario government launched the 2021-2024 CDM Framework on January 1, 2021. The framework focuses on cost-effectively meeting the needs of Ontario’s electricity system, including by focusing on the achievement of provincial peak demand reductions and initiatives such as extended off-peak electricity rates, as well as on targeted approaches to address regional and/or local electricity system needs.

CDM programs are delivered by the Independent Electricity System Operator (IESO), which implemented staff lockdown measures during COVID-19, through the Save on Energy brand. These programs address electricity system needs and help consumers reduce their electricity consumption to lower their bills. CDM programs and incentives are available for homeowners, small businesses, large businesses, and contractors, and First Nations communities.

 

New and Expanded Programs

The four new and expanded CDM programs will include:

A new Residential Demand Response Program for homes with existing central air conditioning and smart thermostats to help deliver peak demand reductions. Households who meet the criteria could voluntarily enroll in this program and, alongside protections like disconnection moratoriums for residential customers, be paid an incentive in return for the IESO being able to reduce their cooling load on a select number of summer afternoons to reduce peak demand. There are an estimated 600,000 smart thermostats installed in Ontario.
Targeted support for greenhouses in Southwest Ontario, including incentives to install LED lighting, non-lighting measures or behind-the-meter distributed energy resources (DER), such as combined solar generation and battery storage.
Enhancements to the Save On Energy Retrofit Program for business, municipalities, institutional and industrial consumers to include custom energy-efficiency projects. Examples of potential projects could include chiller and other HVAC upgrades for a local arena, building automation and air handling systems for a hospital, or building envelope upgrades for a local business.
Enhancements to the Local Initiatives Program to reduce barriers to participation and to add flexibility for incentives for DER solutions.
It is the government’s intention that the new and expanded CDM programs will be available to eligible electricity customers beginning in Spring 2023.

The IESO estimates that the new program offers will deliver total provincial peak electricity demand savings of 285 megawatts (MW) and annual energy savings of 1.1 terawatt hours (TWh) by 2025, reflecting pandemic-era electricity usage shifts across Ontario. Savings will persist beyond 2025 with a total reduction in system costs by approximately $650 million over the lifetime of the measures, and will support economic recovery, as seen with electricity relief during COVID-19 measures, decarbonization and energy cost management for homes and businesses.

These enhancements will have a particular impact in Southwest Ontario, with regional peak demand savings of 225 MW, helping to alleviate electricity system constraints in the region and foster economic development, supported by stable electricity pricing for industrial and commercial companies in Ontario.

The overall savings from this CDM programming will result in an estimated three million tonnes of greenhouse gas emissions reductions over the lifetime of the energy-efficiency measures to help achieve Ontario’s climate targets and protect the environment for the future.

The IESO will be updating the CDM Framework Program Plan, which provides a detailed breakdown of program budgets and energy savings and peak demand targets expected to be achieved.

Electricity and water do mix: How electric ships are clearing the air on the B.C. coast

The river is running strong and currents are swirling as the 150-metre-long Seaspan Reliant slides gently into place against its steel loading ramp on the shores of B.C.'s silty Fraser River.

The crew hustles to tie up the ship, and then begins offloading dozens of transport trucks that have been brought over from Vancouver Island.

While it looks like many vessels working the B.C. coast, below decks, the ship is very different. The Reliant is a hybrid, partly powered by electricity, and joins BC Ferries' hybrid ships in the region, the seagoing equivalent of a Toyota Prius.

Down below decks, Sean Puchalski walks past a whirring internal combustion motor that can run on either diesel or natural gas. He opens the door to a gleaming white room full of electrical cables and equipment racks along the walls.

"As with many modes of transportation, we're seeing electrification, from electric planes to ferries," said Puchalski, who works with Corvus Energy, a Richmond, B.C. company that builds large battery systems for the marine industry.

In this case, the batteries are recharged by large engines burning natural gas.

"It's definitely the way of the future," said Puchalski.

The 10-year-old company's battery system is now in use on 200 vessels around the world. Business has spiked recently, driven by the need to reduce emissions, and by landmark projects such as battery-electric high-speed ferries taking shape in the U.S.

"When you're building a new vessel, you want it to last for, say, 30 years. You don't want to adopt a technology that's on the margins in terms of obsolescence," said Puchalski. "You want to build it to be future-proof."

 

Dirty ships

For years, the shipping industry has been criticized for being slow to clean up its act. Most ships use heavy fuel oil, a cheap, viscous form of petroleum that produces immense exhaust. According to the European Commission, shipping currently pumps out about 940 million tonnes of CO2 each year, nearly three per cent of the global total.

That share is expected to climb even higher as other sectors reduce emissions.

When it comes to electric ships, Scandinavia is leading the world. Several of the region's car and passenger ferries are completely battery powered — recharged at the dock by relatively clean hydro power, and projects such as Kootenay Lake's electric-ready ferry show similar progress in Canada.

 

Tougher regulations and retailer pressure

The push for cleaner alternatives is being partly driven by worldwide regulations, with international shipping regulators bringing in tougher emission standards after a decade of talk and study, while financing initiatives are helping B.C. electric ferries scale up.

At the same time, pressure is building from customers, such as Mountain Equipment Co-op, which closely tracks its environmental footprint. Kevin Lee, who heads MEC's supply chain, said large companies are realizing they are accountable for their contributions to climate change, from the factory to the retail floor.

"You're hearing more companies build it into their DNA in terms of how they do business, and that's cool to see," said Lee. "It's not just MEC anymore trying to do this, there's a lot more partners out there."

In the global race to cut emissions, all kinds of options are on the table for ships, including giant kites being tested to harvest wind power at sea, and ports piloting hydrogen-powered cranes to cut dockside emissions.

Modern versions of sailing ships are also being examined to haul cargo with minimal fuel consumption.

But in practical terms, hybrids and, in the future, pure electrics are likely to play a larger role in keeping the propellers turning along Canada's coast, with neighboring fleets like Washington State Ferries' upgrade underscoring the shift.

Investor: Hydro One has too many unknowns to be a good investment

Hydro One may be only half-owned by the province on Ontario but that’s enough to cause uncertainty about the company’s future, thus making for an investment risk, says Douglas Kee of Leon Frazer & Associates.

Since its IPO in November of 2015, Hydro One has seen its share of ups and downs, including a Q2 profit decline earlier this year, mostly downs at this point. Currently trading at $19.87, the stock has lost 11 per cent of its value in 2018 and 12 per cent over the last 12 months, despite a one-time gain boosting Q2 profit that followed a court ruling.

This year has been a turbulent one, to say the least, as newly elected Ontario premier Doug Ford made good this summer on his campaign promise re Hydro One by forcing the resignation of the company’s 14-person board of directors along with the retirement of its chief executive, an event that saw Hydro One shares fall amid the turmoil. An interim CEO has been found and a new 10-person board and chairman put in place, but Kee says it’s unclear what impact the shakeup will ultimately have, other than delaying a promising-looking deal to purchase US utility Avista Corp, with the companies moving to ask the U.S. regulator to reconsider the order.

 

Douglas Kee’s take on Hydro One stock

“We looked at Hydro One a couple of times two years ago and just decided that with the Ontario government’s still owning a big chunk of the company … there are other public companies where you get the same kind of yield, the same kind of dividend growth, so we just avoided it,” says Kee, managing director and chief investment officer with Leon Frazer & Associates, to BNN Bloomberg.

“The old board versus the new board, I’m not sure that there’s much of an improvement. It was politics more than anything,” he says. “The unfortunate part is that the acquisition they were making in the United States is kind of on hold for now. The regulatory procedures have gone ahead but they are worried, and I guess the new board has to make a decision whether to go ahead with it or not.”

“Their transmissions side is coming up for regulatory hearings next year, which could be difficult in Ontario,” says Kee. “The offset to that is that there are a lot of municipal distributions systems in Ontario that may be sold — they bought one in Peterborough recently, which was a good deal for them. There may be more of that coming too.”

Last month, Hydro One reached an agreement with the City of Peterborough to buy its Peterborough Distribution utility which serves about 37,000 customers for $105 million. Another deal to purchase Orillia Power Distribution Corp for $41 million has been cancelled after an appeal to the Ontario Energy Board was denied in late August. Hydro One’s sought-after Avista Corp acquisition is reported to be worth $7 billion.

Brazil's national electricity workers' collective (CNE) has called for a 72-hour strike to protest the privatization of state-run electric company Eletrobras and its subsidiaries.

The CNE, which gathers the electricity workers' confederation, federations, unions and associations, said the strike is to begin at Monday midnight (0300 GMT) and last through midnight Wednesday, even as some utilities elsewhere have considered asking staff to live on site to maintain operations.

Workers are demanding the ouster of Eletrobras President Wilson Ferreira Jr., who they say is the leading promoter of the privatization move.

Some 24,000 workers are expected to take part in the strike. However, the CNE said it will not affect consumers by ensuring essential services, a pledge echoed by utilities managing costs elsewhere such as Manitoba Hydro's unpaid days off during the pandemic.

Eletrobras accounts for 32 percent of Brazil's installed energy generation capacity, mainly via hydroelectric plants. Besides, it also operates nuclear and thermonuclear plants, and solar and wind farms, reflecting trends captured by young Canadians' interest in electricity jobs in recent years.

The company distributes electricity in six northern and northeastern states, and handles 47 percent of the nation's electricity transmission lines, even as a U.S. grid pandemic warning has highlighted reliability risks.

The government owns a 63-percent stake in the company, a reminder that public policy shapes the sector, similar to Canada's future-of-work investment initiatives announced recently.

How Should California Wind Down Its Fossil Fuel Industry?

California’s energy past is on a collision course with its future. Think of major oil-producing U.S. states, and Texas, Alaska or North Dakota probably come to mind. Although its position relative to other states has been falling for 20 years, California remains the seventh-largest oil-producing state, with 162 million barrels of crude coming up in 2018, translating to tax revenue and jobs.

At the same time, California leads the nation in solar rooftops and electric vehicles on the road by a wide margin and ranking fifth in installed wind capacity. Clean energy is the state’s future, and the state is increasingly exporting its energy policies across the West, influencing regional markets. By law, California must have 100 percent carbon-free electricity by 2045, and an executive order signed by former Governor Jerry Brown calls for economywide carbon-neutrality by the same year.

So how can the state reconcile its divergent energy path? How should clean-energy-minded lawmakers wind down California’s oil and gas sector in a way that aligns with the state’s long-term climate targets while providing a just transition for the industry’s workforce?

Any efforts to reduce fossil fuel supply must run parallel to aggressive demand-reduction measures such as California’s push to have 5 million zero-emission vehicles on the road by 2030, said Ethan Elkind, director of Berkeley Law's climate program, especially amid debates over keeping the lights on without fossil fuels in the near term. After all, if oil demand in California remains strong, crude from outside the state will simply fill the void.

“If we don’t stop using it, then that supply is going to get here, even if it’s not produced in-state,” Elkind said in an interview.

Lawmakers have a number of options for policies that would draw down and eventually phase out fossil fuel production in California, according to a new report from the Center for Law, Energy and the Environment at the UC Berkeley School of Law, co-authored by Elkind and Ted Lamm.

They could impose a higher price on California's oil production through a "severance" tax or carbon-based fee, with the revenue directed to measures that wean the state from fossil fuels. (California, alone among major oil-producing states, does not have an oil severance tax.)

Lawmakers could establish a minimum drilling setback from schools, playgrounds, homes and other sensitive sites. They could push the state's oil and gas regulator, the California Geologic Energy Management Division, to prioritize environmental and climate concerns.

A major factor holding lawmakers back is, of course, politics, including debates over blackouts and climate policy that shape public perception. Given the state’s clean-energy ambitions, it might surprise non-Californians that the oil and gas industry is one of the Golden State’s most powerful special interest groups.

Overcoming a "third-rail issue" in California politics
The Western States Petroleum Association, the sector’s trade group in California's capital of Sacramento, spent $8.8 million lobbying state policymakers in 2019, more than any other interest group. Over the last five years, the group, which cultivates both Democratic and Republican lawmakers, has spent $43.3 million on lobbying, nearly double the total of the second-largest lobbying spender.

Despite former Governor Brown’s reputation as a climate champion, critics say he was unwilling to forcefully take on the oil and gas industry. However, things may take a different turn under Brown's successor, Governor Gavin Newsom.

In May 2019, when Newsom released California's midyear budget revision (PDF), the governor's office noted the need for "careful study and planning to decrease demand and supply of fossil fuels, while managing the decline in a way that is economically responsible and sustainable.”

Related reliability concerns surfaced as blackouts revealed lapses in power supply across the state.

Writing for the advocacy organization Oil Change International, David Turnbull observed, “This may mark the first time that a sitting governor in California has recognized the need to embark upon a managed decline of fossil fuel supply in the state.”

“It is significant because typically this is one of those third-rail issues, kind of a hot potato that governors don’t even want to touch at all — including Jerry Brown, to a large extent, who really focused much more on the demand side of fuel consumption in the state,” said Berkeley Law’s Elkind.

California's revised budget included $1.5 million for a Transition to a Carbon-Neutral Economy report, which is being prepared by University of California researchers for the California Environmental Protection Agency. In an email, a CalEPA spokesperson said the report is due by the end of this year.

Winding down oil and gas production
Since the release of the revised budget last May, Newsom has taken initial steps to increase oversight of the oil and gas industry. In July 2019, he fired the state’s top oil and gas regulator for issuing too many permits to hydraulically fracture, or frack, wells.

Later in the year, he appointed new leadership to oversee oil and gas regulation in the state, and he signed a package of bills that placed constraints on fossil fuel production. The next month, Newsom halted the approval of new fracking operations until pending permits could be reviewed by a panel of scientists at Lawrence Livermore National Laboratory. The California Geologic Energy Management Division (CalGEM) did not resume issuing fracking permit approvals until April of this year.

Not all steps have been in the same direction. This month Newsom dropped a proposal to add dozens of analysts, engineers and geologists at CalGEM, citing COVID-related economic pressure. The move would have increased regulatory oversight on fossil fuel producers and was opposed by the state's oil industry.

Ultimately, more durable measures to wind down fossil fuel supply and demand will require new legislation, even as regulators weigh whether the state needs more power plants to maintain reliability.

A 2019 bill by Assemblymember Al Muratsuchi (D-Torrance), AB 345, would have codified the minimum 2,500-foot setback for new oil and gas wells. However, before the final vote in the Assembly, the bill’s buffer requirement was dropped and replaced with a requirement for CalGEM “to consider a setback distance of 2,500 feet.” The bill passed the Assembly in January over "no" votes from several moderate Democrats; it now awaits action in the Senate.

A bill previously introduced by Assemblymember Phil Ting (D-San Francisco), AB 1745, didn’t even make it that far. Ting’s bill would have required that all new passenger cars registered in the state after January 1, 2040, be zero-emission vehicles (ZEV). The bill died in committee without a vote in April 2018.

But the backing of the California Air Resources Board (CARB), one of the world's most powerful air-quality regulators, could change the political conversation. In March, CARB chair Mary Nichols said she now supports consideration of California establishing a 100 percent zero-emission vehicle sales target by 2030, as policymakers also consider a revamp of electricity rates to clean the grid.

“In the past, I’ve been skeptical about whether that would do more harm than good in terms of the backlash by dealers and others against something that sounded so un-California like,” Nichols said during an online event. “But as time has gone on, I’ve become more convinced that we need to send the longer-term signal about where we’re headed.”

Another complicating factor for California’s political leaders is the lack of a willing federal partner — at least in the short term — in winding down oil and gas production, amid warnings about a looming electricity shortage that could pressure the grid.

Under the Trump administration, the Bureau of Land Management, which oversees 15 million acres of federal land in California, has pushed to open more than 1 million acres of public and private land across eight counties in Central California to fracking. In January 2020, California filed a federal lawsuit to block the move.
