Joseph McCullough runs All Solar Power Services Inc. He is not licensed to do solar work.

David Beers runs Guardian Solar & Energy LLC, yet says: "I don't sell any solar at all. I want nothing to do with it."

That's good, because he too lacks a solar contractor's license.

In fact, neither Beers nor McCullough is licensed to do any kind of work in Florida.

Charles Waterhouse of Plant City knows neither man. But he does have some new solar exhaust fans. He got them after a pitchman claiming to work for "Guardian Solar" sold him equipment from "All Solar Power Inc."

Waterhouse says the workmanship was shoddy. He complained, leading to a consumer investigation with McCullough at its center.

Along the way, a licensed businessman was surprised to find his company's name caught up in the dispute.

McCullough, based in Hillsborough County, and Beers, based in Pinellas, are two of a growing list of businesspeople scrutinized by local and state authorities.

The state Department of Agriculture and Consumer Services has received hundreds of complaints about offers of solar products and services that begin with a proposal for a free energy check.

"It's an industry," said John Zajac, a spokesman for the Better Business Bureau of Southwest Florida in Clearwater, "that's attracted some suspect people."

Why solar?

It's lucrative. Basic energy-saving solar products can run upward of $10,000. It tempts homeowners seeking to reduce energy costs in tough economic times. Tax credits and cash rebates from the federal government and utility companies make it affordable.

The potential of reduced energy costs is what caught the attention of Waterhouse. A man knocked on his door with an offer of a free energy audit and some solar and energy-saving products.

"He talked a good game," Waterhouse recalls.

For $5,000, all of which would be financed, he would get solar exhaust fans, insulation for the attic and a timer and a blanket for his water heater.

Waterhouse checked the contract for a business name and license number and signed the deal.

When the work was done, Waterhouse learned the ducts weren't properly sealed wires from the new water heater timer were not properly covered a new SmartCool device was decreasing energy efficiency.

He called All Solar Power Inc. to complain but was told that the company had no record of doing work for him and that the phone number on his contract was not the company's number.

He complained to Plant City police, who called the issue a "civil matter." Undeterred, Waterhouse continued pushing his complaint until the Hillsborough County Consumer Protection Agency began to investigate.

Working with investigators, Waterhouse soon discovered there were two "All Solar Power'' companies — one licensed, one not.

He would later learn there also are two ''Guardian Solar'' companies — one licensed, one not.

Waterhouse's contract listed the telephone number for McCullough's business, "All Solar Power Services Inc.," but the name, license number and address of the similarly named "All Solar Power Inc." The latter is a licensed company owned by Richard and Jo-Ann Lavigne.

Although McCullough provided some marketing services for the Lavignes, they say they did not know McCullough was using their company name for contracting services.

"I think what they were doing was going out and trying to sell energy products," said Jo-Ann Lavigne, who, with her husband, has run the business since 1977.

McCullough declined comment, other than to say: "We're fair and honest in everything we do. We're clean."

But Hillsborough consumer protection identified McCullough's company, All Solar Power Services Inc., at 1915 N Dale Mabry Highway in Tampa, as the business responsible for Waterhouse's solar troubles.

The state Department of Business and Professional Regulation is investigating allegations that McCullough operated without a license.

McCullough has also come under scrutiny of local law enforcement.

In September 2010, the 49-year-old was arrested and charged with driving under the influence and driving with his license suspended. He pleaded no contest to both charges and was found guilty.

In 2007, he pleaded no contest to possession of marijuana, driving with an invalid license and reckless driving. He was found guilty of reckless driving. The judge withheld adjudication on the other two charges, which means McCullough will not have a conviction on his record after completing probation.

McCullough has also had troubles with the Internal Revenue Service. It filed liens against him in 2009 for failing to pay more than $5,700 in personal income taxes. No lien release has been filed.

In addition to being president of All Solar Power Services Inc., McCullough is listed in corporate records as manager of Florida Energy Auditors LLC and Solar Power Specialist Services LLC, which are both located at his Dale Mabry address.

David Beers' link to the case stems from the odd way the Waterhouse deal went down. The contract said the work would be done by All Solar Power Inc., but the pitchman identified himself as being from Guardian Solar.

Waterhouse was curious. What is Guardian Solar?

It turned out there are two Guardian Solar companies.

David Beers runs Guardian Solar & Energy LLC. He acknowledged he knows McCullough and the salesman who approached Waterhouse, but denied any involvement in the matter.

Beers, 51, is an unlicensed contractor under investigation by the Pinellas County State Attorney's Office for allegations of marketing himself as a licensed contractor in incidents unrelated to the Waterhouse matter.

The state Department of Business and Professional Regulation is investigating allegations that Beers operated without a license. The Pinellas County Construction Licensing Board issued Beers four citations, alleging he marketed himself as a contractor for energy audits and solar work under multiple business names without a license.

Rod Fischer, executive director of the licensing board, said his agency is also investigating complaints that Beers used other companies' information on contracts without permission.

Use of other companies' licenses has been one of the problems Fischer said he is encountering with solar product offers.

"In some cases, they're grabbing somebody's license and putting it on their paperwork," Fischer said.

Glen "Danny" Upchurch says that is what Beers did to him. Upchurch runs "Guardian Solar Inc." He says Beers created a company similar in name Guardian Solar & Energy LLC to confuse people and take his business.

When contacted by the St. Petersburg Times, Upchurch said he did not know "Guardian Solar'' even came up in Waterhouse's complaint.

Upchurch said he was not surprised, because Beers copied his company's name and used it on another job.

"Those two companies work together," Upchurch said of Beers' and McCullough's businesses. Beers "took my name. He was working with All Solar Power."

"It's a mess," said Upchurch, who is licensed. "I already talked to a lawyer. A lot of confusion has been going on."

Upchurch said he has complained to the Pinellas County Construction Licensing Board about Beers.

"It's been a nightmare," he said.

Upchurch noted that unlicensed contractors will employ various tactics to skirt licensing laws when they have had legal or financial troubles that might preclude them from getting local and state licenses.

Like McCullough, Beers has his troubles with the IRS. In December, the IRS filed a $60,000 personal income tax lien against Beers. That follows a $91,000 federal tax lien in 2001 and a $53,000 federal tax lien in 1997. No lien releases have been filed.

In addition to being listed in state corporate records as the manager of Guardian Solar & Energy, Beers also is the manager of Florida Energy Management LLC and a director of Advanced Window & Tex Coat Inc.

Beers denies trying to steal any company's name or business. He said he avoids any work that requires licensing and was not involved at all in Waterhouse's case.

Waterhouse said the troubles he faced taught him a lesson about checking out the companies he deals with.

Hillsborough consumer protection closed the investigation after Waterhouse got his $5,000 back from the finance company.

"After several months of back and forth, we did get our money back," Waterhouse said with a sigh of relief. "So it's over."

The Ontario government is once again extending electricity rate relief for families, small businesses and farms to support those spending more time at home while the province maintains the Stay-at-Home Order in the majority of public health regions. The government will continue to hold electricity prices to the off-peak rate of 8.5 cents per kilowatt-hour, compared with higher peak rates elsewhere in the day, until February 22, 2021. This lower rate is available 24 hours per day, seven days a week for Time-Of-Use and tiered customers.

"We know staying at home means using more electricity during the day when electricity prices are higher, that's why we are once again extending the off-peak electricity rate to provide households, small businesses and farms with stable and predictable electricity bills when they need it most," said Greg Rickford, Minister of Energy, Northern Development and Mines, Minister of Indigenous Affairs. "We thank Ontarians for continuing to follow regional Stay-at-Home orders to help stop the spread of COVID-19."

The off-peak rate came into effect January 1, 2021, providing families, farms and small businesses with immediate electricity rate relief, and for industrial and commercial companies, stable pricing initiatives have provided additional certainty. The off-peak rate will now be extended until the end of day February 22, 2021, for a total of 53 days of emergency rate relief. During this period, and alongside temporary disconnect moratoriums for residential customers, the off-peak price will continue to be automatically applied to electricity bills of all residential, small business, and farm customers who pay regulated rates set by the Ontario Energy Board and get a bill from a utility.

"We extend our thanks to the Ontario Energy Board and local distribution companies across the province, including Hydro One, for implementing this extended emergency rate relief and supporting Ontarians as they continue to work and learn from home," said Bill Walker, Associate Minister of Energy.

Europe's Worst Energy Nightmare Is Becoming Reality

European Energy Crisis shocks markets as Russia slashes gas via Nord Stream, spiking prices and triggering rationing, LNG imports, storage shortfalls, and emergency measures to secure energy security before a harsh winter.

As Russian gas cutoffs upend European energy security, the continent is struggling to cope with what experts say is one of its worst-ever energy crises—and it could still get much worse. 

For months, European leaders have been haunted by the prospect of losing Russia’s natural gas supply, which accounts for some 40 percent of European imports and has been a crucial energy lifeline for the continent. That nightmare is now becoming a painful reality as Moscow slashes its flows in retaliation for Europe’s support for Ukraine, dramatically increasing energy prices and forcing many countries to resort to emergency plans, including emergency measures to limit electricity prices in some cases, and as backup energy suppliers such as Norway and North Africa are failing to step up.

“This is the most extreme energy crisis that has ever occurred in Europe,” said Alex Munton, an expert on global gas markets at Rapidan Energy Group, a consultancy. “Europe [is] looking at the very real prospect of not having sufficient gas when it’s most needed, which is during the coldest part of the year.”

“Prices have shot through the roof,” added Munton, who noted that European natural gas prices—nearly $50 per MMBTu—have eclipsed U.S. price rises by nearly tenfold, and that rolling back electricity prices is tougher than it appears in the current market. “That is an extraordinarily high price to be paying for natural gas, and really there is no immediate way out from here.” 

Many officials and energy experts worry that the crisis will only deepen after Nord Stream 1, the largest gas pipeline from Russia to Europe, is taken down for scheduled maintenance this week. Although the pipeline is supposed to be under repair for only 10 days, the Kremlin’s history of energy blackmail and weaponization has stoked fears that Moscow won’t turn it back on—leaving heavily reliant European countries in the lurch. (Russia’s second pipeline to Germany, Nord Stream 2, was killed in February as Russian President Vladimir Putin prepared to invade Ukraine, leaving Nord Stream 1 as the biggest direct gas link between Russia and Europe’s biggest economy.)

“Everything is possible. Everything can happen,” German economy minister Robert Habeck told Deutschlandfunk on Saturday. “It could be that the gas flows again, maybe more than before. It can also be the case that nothing comes.”

That would spell trouble for the upcoming winter, when demand for energy surges and having sufficient natural gas is necessary for heating. European countries typically rely on the summer months to refill their gas storage facilities. And at a time of war, when the continent’s future gas supply is uncertain, having that energy cushion is especially crucial.

If Russia’s prolonged disruptions continue, experts warn of a difficult winter: one of potential rationing, industrial shutdowns, and even massive economic dislocation. British officials, who just a few months ago warned of soaring power bills for consumers, are now warning of even worse, despite a brief fall to pre-Ukraine war levels in gas prices earlier in the year.

Europe could face a “winter of discontent,” said Helima Croft, a managing director at RBC Capital Markets. “Rationing, industrial shut-ins—all of that is looming.”

Unrest has already been brewing, with strikes erupting across the continent as households struggle under the pressures of spiraling costs of living and inflationary pressures. Some of this discontent has also had knock-on effects in the energy market. In Norway, the European Union’s biggest supplier of natural gas after Russia, mass strikes in the oil and gas industries last week forced companies to shutter production, sending further shockwaves throughout Europe.

European countries are at risk of descending into “very, very strong conflict and strife because there is no energy,” Frans Timmermans, the vice president of the European Commission, told the Guardian. “Putin is using all the means he has to create strife in our societies, so we have to brace ourselves for a very difficult period.”

The pain of the crisis, however, is perhaps being felt most clearly in Germany, which has been forced to turn to a number of energy-saving measures, including rationing heated water and closing swimming pools. To cope with the crunch, Berlin has already entered the second phase of its three-stage emergency gas plan; last week, it also moved to bail out its energy giants amid German utility troubles that have been financially slammed by Russian cutoffs. 

But it’s not just Germany. “This is happening all across Europe,” said Olga Khakova, an expert on European energy security at the Atlantic Council, who noted that France has also announced plans to nationalize the EDF power company as it buckles under mounting economic losses, and the EU outlines gas price cap strategies to temper volatility. “The challenging part is how much can these governments provide in support to their energy consumers, to these companies? And what is that breaking point?”

The situation has also complicated many countries’ climate goals, even as some call it a wake-up call to ditch fossil fuels for Europe. In late June, Germany, Italy, Austria, and the Netherlands announced they would restart old coal power plants as they grapple with shrinking supplies. 

The potential outcomes that European nations are grappling with reveal how this crisis is occurring on a scale that has only been seen in times of war, Munton said. In the worst-case scenario, “we’re talking about rationing gas supplies, and this is not something that Europe has had to contend with in any other time than the wartime,” he said. “That’s essentially where things have got to now. This is an energy war.”

They also underscore the long and painful battle that Europe will continue to face in weaning itself off Russian gas. Despite the continent’s eagerness to leave Moscow’s supply behind, experts say Europe will likely remain trapped in this spiraling crisis until it can develop the infrastructure for greater energy independence—and that could take years. U.S. gas, shipped by tanker, is one option, but that requires new terminals to receive the gas and U.S. energy impacts remain a factor for policymakers. New pipelines take even longer to build—and there isn’t a surfeit of eligible suppliers.

Until then, European leaders will continue to scramble to secure enough supplies—and can only hope for mild weather. The “worst-case scenario is people having to choose between eating and heating come winter,” Croft said.

Cost, safety drive line-burying decisions at Tucson Electric Power

Though wildfires in California caused by power lines have prompted calls for more underground lines, Tucson Electric Power Co. plans to keep to its policy of burying lines selectively for safety.

Like many other utilities, TEP typically doesn’t install its long-range, high-voltage transmission lines, such as the TransWest Express project, and distribution equipment underground because of higher costs that would be passed on to ratepayers, TEP spokesman Joe Barrios said.

But the company will sometimes bury lower-voltage lines and equipment where it is cost-effective or needed for safety as utilities adapt to climate change across North America, or if customers or developers are willing to pay the higher installation costs

Underground installations generally include additional engineering expenses, right-of-way acquisition for projects like the New England Clean Power Link in other regions, and added labor and materials, Barrios said.

“This practice avoids passing along unnecessary costs to customers through their rates, so that all customers are not asked to subsidize a discretionary expenditure that primarily benefits residents or property owners in one small area of our service territory,” he said, adding that the Arizona Corporation Commission has supported the company’s policy.

Even so, TEP will place equipment underground in some circumstances if engineering or safety concerns, including electrical safety tips that utilities promote during storm season, justify the additional cost of underground installation, Barrios said.

In fact, lower-voltage “feeder” lines emerging from distribution substations are typically installed underground until the lines reach a point where they can be safely brought above ground, he added.

While in California PG&E has shut off power during windy weather to avoid wildfires in forested areas traversed by its power lines after events like the Drum Fire last June, TEP doesn’t face the same kind of wildfire risk, Barrios said.

Most of TEP’s 5,000 miles of transmission and distribution lines aren’t located in heavily forested areas that would raise fire concerns, though large urban systems have seen outages after station fires in Los Angeles, he said.

However, TEP has an active program of monitoring transmission lines and trimming vegetation to maintain a fire-safety buffer zone and address risks from vandalism such as copper theft where applicable, in compliance with federal regulations and in cooperation with the U.S. Bureau of Land Management and the U.S. Forest Service.

Japan's power demand has been hit by a slowdown in industrial activity due to the coronavirus outbreak, reflecting broader shifts in electricity demand worldwide, Japanese utilities federation's head said on Friday, without giving specific figures.

Electricity load profiles during lockdowns revealed changes in daily routines, as shown by lockdown electricity data across multiple regions.

Analysts have identified key shifts in U.S. electricity consumption patterns that mirror industrial slowdowns.

"We are closely watching development of the pandemic, underscoring the need for electricity during such crises, as further reduction in corporate and economic activities would lead to serious impacts," Satoru Katsuno, the chairman of Japan's federation of electric utilities and president of Chubu Electric Power Co Inc, told a news conference.

In parallel, the power industry has intensified coordination with federal partners to sustain grid reliability and protect critical workers.

Some governments, including Brazil, considered emergency loans for the power sector to stabilize utilities amid revenue pressures.

Consumer advocates warned that pandemic-related electricity shut-offs and bill burdens could exacerbate energy insecurity for vulnerable households.
