IndiaÂ’s Parliament approved a final, critical piece of a long-delayed landmark civil nuclear agreement, a pact regarded as a cornerstone of a Bush-era effort to transform the relationship between the United States and the worldÂ’s largest democracy.

But even as supporters praised a historic victory, the end result is probably not what the United States had hoped for, nor does it seem likely to signal a new era in relations between the United States and India. Indeed, some analysts say the compromises needed to move MondayÂ’s legislation through IndiaÂ’s contentious Parliament could undermine the practical impact of a political, diplomatic and economic accord that took years to negotiate.

With President Obama scheduled to make his first visit to India in early November, the governments in both countries are trying to strengthen a relationship sometimes described as a natural and strategic alliance of democracies. But drawing closer has proved complicated as differences remain on issues like trade and climate change, as well as how to effectively deal with Pakistan.

The nuclear issue, putatively about IndiaÂ’s future, has set off weeks of bitter political debate in New Delhi and tapped into Indian nationalism and public suspicion of foreign corporate interests, while also dredging up a very different chapter in the countriesÂ’ relations: the 1984 Union Carbide industrial disaster at Bhopal, which killed thousands. Prime Minister Manmohan Singh, accused of toadying to the United States, appeared before the lower house of Parliament to deny that his allegiance was anywhere but with India.

“We kind of assume that we will be the dominant partner in any partnership,” said Teresita C. Schaffer, a former ambassador to Sri Lanka who also served as an American diplomat in India. “India does not make that assumption.”

Mr. Singh, who announced the nuclear deal in a 2005 joint statement with former President George W. Bush, has an expansive vision of the role of nuclear energy as a power source for IndiaÂ’s future. For decades after its 1974 nuclear test, India had refused to sign the Nuclear Nonproliferation Treaty and was subjected to a three-decade American moratorium on nuclear trade. But the deal opened a controversial back door for India to join the nuclear club while also opening an Indian market estimated at $150 billion to foreign energy companies once blocked by the moratorium.

Now the question is whether foreign or even Indian energy companies will be willing to come in to provide the expertise India needs to expand, because of the liability guidelines codified in the legislation in case of a nuclear accident. Existing international conventions place liability solely with the operator of a nuclear reactor while immunizing suppliers. But the Indian law bucks international norms and makes suppliers potentially liable, too. Indian industrial groups have already expressed reservations, while analysts warn that many private foreign energy companies may now decide not to take part.

“This makes the fruits of the Indo-U.S. deal go to waste,” said G. Balachandran, a security analyst in New Delhi with a specialty in nuclear issues. He added: “It may well be the end of civil nuclear growth in India.”

India currently has 19 nuclear reactors, and the government wants to attract foreign and domestic suppliers to build more. The liability legislation was critical, because most private foreign energy companies need a legal framework outlining their risks and potential liabilities before entering a market. International conventions largely abide by a principle in which liability is “channeled” strictly to the operator of a reactor rather than the long list of suppliers.

The legislation still requires the signature of the president, a ceremonial gesture that is virtually guaranteed. During the debate before the vote in the upper house of India’s Parliament, the government’s point man, Prithviraj Chavan, said the law would make India the sole country in the world that placed some liability on suppliers. “The suppliers are not happy,” Mr. Chavan said.

The government originally proposed legislation more palatable to suppliers, but opposition parties had demanded tougher provisions, particularly after the ghost of the Bhopal disaster inflamed the debate.

In Bhopal, thousands of people were killed after a leak in December 1984 at the Union Carbide pesticide factory unleashed a poisonous cloud over the city. India sought $3.3 billion in damages from Union Carbide, since purchased by the Dow Chemical Company, but would later settle for $470 million. Much of the money has not been distributed, and many victims have gotten only nominal payments.

In June, IndiaÂ’s court system announced light criminal sentences against eight former executives of Union CarbideÂ’s Indian subsidiary, one of whom had since died. Meanwhile, Warren M. Anderson, the former chairman of Union Carbide, has never been prosecuted, and he still lives in the United States, which has declined to extradite him. After the issue resurfaced, the public was outraged, and the Bhopal tragedy again dominated the Indian media.

Then on August 19, an Indian news channel reported that a senior American official had cautioned a top Indian official in an e-mail that the “noise” over the Dow Chemical Company could hurt investment in India. The official, Mike Froman, a deputy national security adviser, issued a statement denying that he was making any sort of threat — but the episode further inflamed the nuclear debate.

The Bharatiya Janata Party, or B.J.P., the main opposition, insisted on language that left open the possibility that suppliers could be sued in the case of an accident.

Arun Jaitley, the B.J.P. leader in the upper house, scoffed at the notion that foreign energy companies would stay away from India. He said India’s appetite for new nuclear reactors would create a “buyer’s market” and the law would provide leverage for the government. He said the law abided by the principle of channeling by holding only the operator liable for claims from accident victims. The difference, he said, is that the law allows an operator to sue a supplier under certain circumstances.

Had the law not been changed, he said it would have been “a suppliers’ immunity law.”

But Indian business groups and even the governmentÂ’s own Nuclear Power Corporation, which operates the existing reactors, have warned that such liability language was problematic and could dissuade private suppliers. India already has a separate bilateral agreement with Russia, and liability is less central an issue since Russian companies are state-owned. Yet Russia also has expressed concern. Private companies in other countries, including France, which also has a bilateral agreement with India, could be more exposed. And Japan, which is also negotiating a nuclear agreement with India, is likely to raise the issue since Japanese companies are heavily involved in the industry.

“It really increases the exposure of Indian and international suppliers,” said Ashley Tellis, a former American diplomat involved in negotiating the framework of the United States-India deal. “The net effect is that it is going to restrict the prime minister’s options and it could even be fatal to his vision of expanding the nuclear power sector in India.”

Ontario's primary electricity provider says it's extending a ban on disconnecting homes from the power grid until further notice.

Hydro One first issued the ban towards the beginning of the province's COVID-19 outbreak, saying self-isolating customers needed to be able to rely on electricity while they were kept at home during the pandemic.

A spokesman for the utility says the ban was initially set to expire at the end of July, but has now been extended in a manner similar to winter disconnection bans without a fixed end-date.

Hydro One says the move is necessary given the ongoing restrictions posed by the pandemic, and notes it has supported provincial COVID-19 efforts in recent months, as well as persistent hot weather across much of the province.

It says it's also planning to extend a financial relief program to help customers struggling to pay their hydro bills, reflecting demand for more choice and flexibility among ratepayers.

The province also extended off-peak electricity rates to provide relief for families, small businesses and farms during this period.

SaskPower to buy more electricity from Manitoba Hydro

Saskatchewan's Crown-owned electric utility has made an agreement to buy more hydroelectricty from Manitoba.

A term sheet providing for a new long--term power sale has been signed between Manitoba Hydro and SaskPower which will see up to 215 megawatts flow from Manitoba to Saskatchewan, as new turbine investments advance in Manitoba, beginning in 2022.

SaskPower has two existing power purchase agreements with Manitoba Hydro that were made in 2015 and 2016, but the newest one announced Monday is the largest, as financial pressures at Manitoba Hydro continue.

SaskPower President and CEO Mike Marsh says in a news release that the clean, hydroelectric power represents a significant step forward when it comes to reaching the utility's goal of reducing greenhouse gas emissions by 40 per cent by 2030, aligning with progress on renewable electricity by 2030 initiatives.

Marsh says it's also reliable baseload electricity, which SaskPower will need as it adds more intermittent generation options like wind and solar.

SaskPower says a final legal contract for the sale is expected to be concluded by mid-2019 and be in effect by 2022, and the purchase agreement would last up to 30 years.

"Manitoba Hydro has been a valued neighbour and business partner over the years and this is a demonstration of that relationship," Marsh said in the news release.

The financial terms of the agreement are not being released, though SaskPower's latest annual report offers context on its finances.

Both parties say the sale will partially rely on the capacity provided by a new transmission line planned for construction between Tantallon, Sask. and Birtle, Man. that was previously announced in 2015 and is expected to be in service by 2021.

"Revenues from this sale will assist in keeping electricity rates affordable for our Manitoba customers, while helping SaskPower expand and diversify its renewable energy supply," Manitoba Hydro president and CEO Kelvin Shepherd said in the utility's own news release.

In 2015, SaskPower signed a 25 megawatt agreement with Manitoba Hydro that lasts until 2022. A 20-year agreement for 100 megawatts was signed in 2016 and comes into effect in 2020, and SaskPower is also exploring a purchase from Flying Dust First Nation to further diversify supply.

The deals are part of a memorandum of understanding signed in 2013 involving up to 500 megawatts.

Gross electricity consumption in Germany will increase from 595 terawatt hours (TWh) in 2018 to 658 TWh in 2030. That is an increase of eleven percent. This emerges from the detailed analysis of the development of electricity demand that the Federal Ministry of Economics (BMWi) published on Tuesday. The main driver of the increase is therefore the transport sector. According to the paper, increased electric mobility in particular contributes 68 TWh to the increase, in line with rising EV power demand trends across markets. Around 44 TWh of this should be for cars, 7 TWh for light commercial vehicles and 17 TWh for heavy trucks. If the electricity consumption for buses and two-wheelers is added, this results in electricity consumption for e-mobility of around 70 TWh.

The number of purely battery-powered vehicles is increasing according to the investigation by the BMWi to 16 million by 2030, reflecting the global electric car market momentum, plus 2.2 million plug-in hybrids. In 2018 there were only around 100,000 electric cars, the associated electricity consumption was an estimated 0.3 TWh, and plug-in mileage in 2021 highlighted the rapid uptake elsewhere. For heat pumps, the researchers predict an increase in demand by 35 TWh to around 42 TWh. They estimate the electricity consumption for the production of around 12.5 TWh of green hydrogen in 2030 to be just under 20 TWh. The demand at battery factories and data centers will increase by 13 TWh compared to 2018 by this point in time. In the data centers, there is no higher consumption due to more efficient hardware despite advancing digitization.

The updated figures are based on ongoing scenario calculations by Prognos, in which the market researchers took into account the goals of the Climate Protection Act for 2030 and the wider European electrification push for decarbonization. In the preliminary estimate presented by Federal Economics Minister Peter Altmaier (CDU) in July, a range of 645 to 665 TWh was determined for gross electricity consumption in 2030. Previously, Altmaier officially said that electricity demand in this country would remain constant for the next ten years. In June, Chancellor Angela Merkel (CDU) called for an expanded forecast that would have to include trends in e-mobility adoption within a decade and the Internet of Things, for example.

Higher electricity demand
The Federal Association of Energy and Water Management (BDEW) is assuming an even higher electricity demand of around 700 TWh in nine years. In any case, a higher share of renewable energies in electricity generation of 70 percent by 2030 is necessary in order to be able to achieve the climate targets and to address electricity price volatility risks. The expansion paths urgently need to be increased and obstacles removed. This could mean around 100 gigawatts (GW) for onshore wind turbines, 11 GW for biomass and at least 150 GW for photovoltaics by 2030. Faster network expansion and renovation will also become even more urgent, as electric cars challenge grids in many regions.

Texas has a unique state-run power grid facing a Texas grid crisis that has raised concerns, but its issues with extreme weather, and balancing natural gas and wind, hold lessons for an entire U.S. at risk for power outages from climate change.

Grid operator the Electric Reliability Council of Texas, or ERCOT, which has drawn criticism from Elon Musk recently, called on consumers to voluntarily reduce power use on Monday when dangerous heat gripped America’s second-most populous state.

The action paid off as the Texas grid avoided blackouts — and a repeat of its winter crisis — despite record or near-record temperatures that depleted electric supplies amid a broader supply-chain crisis affecting utilities this summer, and risked lost power to more than 26 million customers. ERCOT later on Monday lifted the call for conservation.

For sure, it’s a unique situation, as the state-run power grid system runs outside the main U.S. grids. Still, all Americans can learn from Texas about the fragility of a national power grid that is expected to be challenged more frequently by hot and cold weather extremes brought on by climate change, including potential reliability improvements policymakers are weighing.

The grid will also be tested by increased demand to power electric vehicles (EVs) and conversions to electric heat pumps — all as part of a transition to a “greener” future.

 

Why is Texas different?
ERCOT, the main, but not only, Texas grid, is unique in its state-run, and not regional, format used by the rest of the country. Because it’s an energy-rich state, Texas has been able to set power prices below those seen in other parts of the country, and its independence gives it more pricing authority, while lawmakers consider market reforms to avoid blackouts. But during unusual strain on the system, such as more people blasting their air conditioners longer to combat a record heat wave, it also has no where else to turn.

A lethal winter power shortage in February 2021, during a Texas winter storm that left many without power and water, notoriously put the state and its independent utility in the spotlight when ERCOT failed to keep residents warm and pipes from bursting. Texas’s 2021 outage left more than 200 people dead and rang up $20 billion in damage. Fossil-fuel CL00, 0.80% backers pointed to the rising use of intermittent wind power, which generates 23% of Texas’s electricity. Others said natural-gas equipment was frozen under the extreme conditions.

This week, ERCOT is asking for voluntary conservation between 2 p.m. and 8 p.m. local time daily due to record high electricity demand from the projected heat wave, and also because of low wind. ERCOT said current projections show wind generation coming in at less than 10% of capacity. ERCOT stressed that no systemwide outages are expected, and Gov. Greg Abbott has touted grid readiness heading into fall, but it was acting preemptively.

A report late last year from the North American Electric Reliability Corp. (NERC) said the Texas system without upgrades could see a power shortfall of 37% in extreme winter conditions. NERC’s outlook suggested the state and ERCOT isn’t prepared for a repeat of weather extremes.

Charting a path to net zero electricity emissions by the middle of the century

The world has been put on notice. Last year, both the UN Intergovernmental Panel on Climate Change and the U.S. National Climate Assessment warned that we need to slash greenhouse gas emissions to avoid disastrous impacts of global warming. Their direct language forecasting devastating effects on our health, economics, environment, and ways of life has made even more urgent the responsibility we all have to act boldly to combat the climate crisis.

This week, we’re adding one important tool for addressing the climate crisis to the national conversation.

Together, we’re taking that bold action. The Climate reports made clear that to limit the global temperature rise and stave off devastating impacts to our climate—human-caused CO2 emissions must fall rapidly by 2030 and that we, as a global community, underscored at the Katowice climate talks, must reach net-zero emissions by the middle of the century. The Clean Energy Standard is federal legislation that offers a pathway toward decarbonizing our power sector and helping our nation accomplish a goal of net-zero emissions by the 2050s.

Under this plan, any company selling retail electricity will have a mandate to increase the amount of clean energy provided to its customers. It will incentivize clean electricity investment to put the U.S. on a sustainable path.

To deal most effectively with a crisis, all tools must be on the table. Our plan focuses solely on emissions, and there is a place for all technologies that can put us on the path to net zero. That will mean drastic increases in wind and solar energy for sure, as states like California pursue a 100% carbon-free electricity mandate to accelerate deployment, but nuclear power, hydro power, and fossil fuels with carbon capture and storage all have important roles to play.

We’re doing this because the science is clear – tackling our climate crisis requires serious and rapid action to control greenhouse gas emissions, and the push for decarbonization is irreversible according to many. Inaction on the climate crisis puts our families at risk, and we’re not wasting any time. This is also an opportunity to create good-paying green jobs that can last generations and uplift the middle class.

We are doing this for the environment, but also for jobs and economic competitiveness. The green economy is the future and we’re ready to see it grow, with states like New York advancing a Green New Deal that drives innovation. The United States can lead, or we can follow, and we want our nation to lead.

And, because as a New Mexican and a Minnesotan, we know that the impacts of climate change go far beyond the headlines and political discourse. It means devastation within tamarack forests and an increase in deadly fires. It means hotter summers and shorter winters with extreme temperature swings throughout the year. It means devastating flash floods with increasingly intense rain. It’s impacting our pocketbooks when farmers and small businesses who work the land in rural communities are unable to make ends meet.

States across the country are already acting to combat the climate crisis – including Minnesota's 2050 carbon-free electricity plan and New Mexico. But in order to truly address climate change, we have to be in this together as Americans. If the problem is far-reaching, our solutions must be equally as holistic.

It's why we've worked with green groups and activists, unions, and communities across the country - from urban to rural - to create a solution that understands the different starting points communities face in reaching net zero emissions, but doesn't shrink from the absolute need to reach that standard.

There is not one solution to climate change – it will take a collective group of individuals prepared to boldly act. And we are ready to take on that fight.

In Congress, we have formed the House Select Committee on the Climate Crisis and the Senate Democrats’ Special Committee on the Climate Crisis to hear from everyday Americans how climate change is affecting them – and how we can come together to find solutions that build on the historic climate deal passed this year. We have heard the stories of young people worried about their futures. And we realize there is a sense of urgency to act.

Over the coming weeks and months, we will be building support from communities across the country to make this plan a reality. We will continue working with stakeholders to ensure every voice is heard. Most importantly, we will continue listening to you and your communities.

Enel kicks off 90MW Spanish wind build

Enel Green Power España Aragon wind farms advance Spain's renewable energy transition, with 90MW under construction in Teruel, Endesa investment of €88 million, 25-50MW turbines, and 2017 auction-backed capacity enhancing grid integration and clean power.

Enel Green Power Espana, part of Enel's wind projects worldwide, has started constructing three wind farms in Aragon, north-east Spain, which are due online by the end of the year.

The projects, all situated in the Teruel province, are worth a total investment of €88 million.

The biggest of the facilities, Sierra Costera I, will have a 50MW and will feature 14 turbines.

The wind farm is spread across the municipalities of Mezquita de Jarque, Fuentes Calientes, Canada Vellida and Rillo.

The Allueva wind facility will feature seven turbines and will exceed 25MW.

Sierra Pelarda, in Fonfria, will have four turbines and a capacity of 15MW, as advances in offshore wind turbine technology continue to push scale elsewhere.

The projects bring the total number of wind farms that Enel Green Power Espana has started building in the Teruel province to six, equal to an overall capacity of 218MW.

Endesa chief executive Jose Bogas said: “These plants mark the acceleration on a new wave of growth in the renewable energy space that Endesa is committed to pursue in the next years, driving the energy transition in Spain.”

The six wind farms under construction in Teruel are part of the 540MW that Enel Green Power Espana was awarded in the Spanish government's renewable energy tender held in May 2017.

In Aragon, the company will invest around €434 million euros, reflecting broader European wind power investment trends in recent years, to build 13 wind farms with a total installed capacity of more than 380MW.

The remaining 160MW of wind capacity will be located in Andalusia, Castile-Leon, Castile La Mancha and Galicia, even as some Spanish turbine factories closed during pandemic restrictions.

Enel Green Power Espana was also awarded 339MW of solar capacity in the Spanish government's auction held in July 2017, while other Spanish developers advance CSP projects abroad in markets like Chile.

Once all wind and solar under the 2017 tender are complete they will boost the company’s capacity by around 52%.
