State power utility Eskom claims to be expediting regulations to enable it to expropriate land it requires for transmission-line servitudes, because the acquisition process is said to be taking too long.

The utility has also made it apparent that most of the delays relate to land owned by non-South Africans, many of whom are absentee landlords.

Earlier in the year, CEO Jacob Maroga indicated that the acquisition of land and servitude rights had emerged as a major challenge. "Timelines are tight," Maroga warned, pointing out that Eskom was aiming to spend some R15,5-billion on long-distance transmission lines up until 2012.

Now, Eskom Enterprises CEO Brian Dames - who has overall responsibility for the corporation's R200-billion-plus capital programme, involving both generation and transmission infrastructure - has again confirmed that there is growing anxiety at Eskom over the issue.

He also indicated that resorting to legal resolution was now viewed as the only realistic route to deal with the matter.

Speaking to the South African contractor community recently, Dames said that, while there were some initial difficulties in obtaining environmental approvals for transmission projects, land acquisition had since emerged as the most serious constraint.

"Most of the land is owned by farmers, and a lot of these farmers are foreigners, and that is where we are having most of our problems," Dames reported, adding that it was now looking to secure the land through an expropriation process.

"There is one line where we have just five kilometres missing, because the land owner is refusing to give us access. This is effectively holding back the expansion in the platinum basin. We cannot have this as a country and that alignment needs to happen very, very quickly," Dames asserted.

He also stressed that the transmission aspect of Eskom's expenditure, while far smaller than that required to expand the generation system, was as crucial for dealing with the current electricity-supply constraints.

For instance, it was vital that servitudes were secured to link the R78,6-billion Medupi, to be built in Limpopo province, into the system in Gauteng.

Transmission strengthening and expansion projects currently under way included a 1 500 km, 765kV line from Johannesburg to Cape Town, where tower lifting had started. These 42-m high and 39-t towers were being installed by a Japanese/South African joint venture and stringing should begin within weeks.

The utility had also recently completed a 400-km, 400-kV line into the Eastern Cape, which was the longest 400-kV line in the country, as well as some system strengthening into the Western Cape.

Work was being planned for another line into the Eastern Cape to feed into the Coega Industrial Development Zone (IDZ), incorporating the $2,7-billion Rio Tinto Alcan aluminium project, which is the anchor tenant for the IDZ, near Port Elizabeth, while there were further strengthening and expansion projects scheduled for both the Western Cape and KwaZulu-Natal.

About 94,000 customers were without electricity Saturday night after the Los Angeles Department of Water and Power shut down a power station in the northeast San Fernando Valley that caught fire, the agency said.

The fire at the station in the Northridge/Reseda area of Los Angeles started about 6:52 p.m. and involved equipment that carries high-voltage electricity and distributes it at lower voltages to customers in the surrounding area, the department said, even as other utilities sometimes deploy wildfire safety shut-offs to reduce risk during dangerous conditions.

The department shut off power to the station as a precautionary move, and it is restoring power now that the fire has been put out, similar to restoration after intentional shut-offs in other parts of California. Initially, 140,000 customers were without power. That number had been cut to 94,000 by 11 p.m.

The power outage comes as much of California baked in heat that broke records, and rolling blackout warnings were issued as the grid strained. A record that stood 131 years in Los Angeles was snapped when the temperature spiked at 98 degrees downtown.

People reported losing power in Porter Ranch, Winnetka, West Hills, Canoga Park, Woodland Hills, Granada Hills, North Hills, Reseda and Chatsworth, KABC TV reported, highlighting electricity inequality across communities.

Shortly after the blaze broke out, firefighters found a huge container of mineral oil that is used to cool electrical equipment on fire, Los Angeles Fire Department spokesman Brian Humphrey told the Los Angeles Times. The incident underscores infrastructure risks that in some regions have required a complete grid rebuild after severe storms.

Firefighters had the blaze under control by 8:30 p.m. and were able to put it out by 9 p.m., Humphrey said. "These were fierce flames, with smoke towering more than 300 feet into the sky," he told the newspaper.

No one was injured.

Firefighters rescued people who were stranded in elevators, Humphrey said.

A manufacturer of steel rail cars is pursuing an appeal after its lawsuit challenging the constitutionality of a major Ontario electricity fee was struck down earlier this year.

Lawyers for Hamilton, Ont.-based National Steel Car Ltd. filed a notice of appeal in July after Ontario Superior Court Justice Wendy Matheson ruled in June that an electricity fee known as the global adjustment charge was a regulatory charge, and not an unconstitutional tax used to finance policy goals, as National Steel Car alleges.

The company, the decision noted, began its legal crusade last year after seeing its electricity bills had “increased dramatically” since the Ontario government passed green energy legislation nearly a decade ago, and amid concerns that high electricity rates are hurting Ontario manufacturers.

Under that legislation, the judge wrote, “private suppliers of renewable energy were paid to ’feed in’ energy into Ontario’s electricity grid.” The contracts for these so-called “feed-in tariff” contracts, or FIT contracts, were the “primary focus” of the lawsuit.

“The applicant seeks a declaration that part of the amount it has paid for electricity is an unconstitutional tax rather than a valid regulatory charge,” the judge added. “More specifically, it challenges part of the Global Adjustment, which is a component of electricity pricing and incorporates obligations under FIT contracts.”

Chiefly representing the difference between Ontario’s market price for power and the guaranteed price owed to generators, global adjustment now makes up the bulk of the commodity cost of electricity in the province. The fee has risen over the past decade, amid calls to reject steep Nova Scotia rate hikes as well — costing electricity customers $37 billion in global adjustment from 2006 to 2014, according to the province’s auditor general — because of investments in the electricity grid and green-energy contracts, among other reasons.

National Steel Car argued the global adjustment is a tax, and an unconstitutional one at that because it violated a section of the Constitution Act requiring taxes to be authorized by the legislature. The company also said the imposition of the global adjustment broke an Ontario law requiring a referendum to be held for new taxes.

The province, Justice Matheson wrote, had argued “that it is plain and obvious that these applications will fail.” In a decision released in June, the judge granted motions to strike out National Steel Car’s applications.

“The Global Adjustment,” she added, “is not a tax because its purpose, in pith and substance, is not to tax, and it is a regulatory charge and therefore, again, not a tax.”

Now, National Steel Car is arguing that the judge erred in several ways, including in fact, “by finding that the FIT contracts must be paid, when they can be cancelled.”

There has been a change in government at Queen’s Park since National Steel Car first filed its lawsuit last year, and that change has put green energy contracts under fire. The Progressive Conservative government of new Premier Doug Ford has already made a number of decisions on the electricity file, such as moving to cancel and wind down more than 750 renewable energy contracts, as well as repealing the province’s Green Energy Act.

The Tories also struck a commission of inquiry into the province’s finances that warned the global adjustment “may be struck down as unconstitutional,” a warning delivered amid cases where Nova Scotia's regulator approved a 14% rate hike in a high-profile decision.

“There is a risk that a court may find the global adjustment is not a valid regulatory charge if shifting costs over a longer period of time inadvertently results in future ratepayers cross-subsidizing today’s ratepayers,” the commission’s report said.

A spokesperson for Ontario’s Ministry of Energy, Northern Development and Mines said in an email that it would be “inappropriate to comment about the specifics of any case before the courts or currently under arbitration.”

National Steel Car is also prepared to fight its case all the way up to the Supreme Court of Canada, according to its lawyer.

“What is clear from our proceeding with the appeal is National Steel Car has every intention of seeing that lawsuit through to its conclusion if this government isn’t interested or prepared to reasonably settle it,” Jerome Morse said.

Bangladesh develops nuclear power with IAEA Assistance

The beginning of construction at Bangladesh’s first nuclear power reactor on 30 November 2017 marked a significant milestone in the decade-long process to bring the benefits of nuclear energy to the world’s eighth most populous country. The IAEA has been supporting Bangladesh on its way to becoming the third ‘newcomer’ country to nuclear power in 30 years, following the United Arab Emirates in 2012 and Belarus in 2013.

Bangladesh is in the process of implementing an ambitious, multifaceted development programme to become a middle-income country by 2021 and a developed country by 2041. Vastly increased electricity production, with the goal of connecting 2.7 million more homes to the grid by 2021, is a cornerstone of this push for development, and nuclear energy will play a key role in this area, said Mohammad Shawkat Akbar, Managing Director of Nuclear Power Plant Company Bangladesh Limited. Bangladesh is also working to diversify its energy supply to enhance energy security, reduce its dependence on imports and on its limited domestic resources, he added.

#google# In the region, India's nuclear program is taking steps to get back on track, underscoring broader momentum.

“Bangladesh is introducing nuclear energy as a safe, environmentally friendly and economically viable source of electricity generation,” said Akbar.  The plant in Rooppur, 160 kilometres north-west of Dhaka, will consist of two units, with a combined power capacity of 2400 MW(e). It is being built by a subsidiary of Russia’s State Atomic Energy Corporation ROSATOM. The first unit is scheduled to come online in 2023 and the second in 2024, reflecting progress similar to the UK's latest nuclear power station developments.  “This project will enhance the development of the social, economic, scientific and technological potential of the country,” Akbar said.

The country’s goal of increased electricity production via nuclear energy will soon be a reality, Akbar said. “For 60 years, Bangladesh has had a dream of building its own nuclear power plant. The Rooppur Nuclear Power Plant will provide not only a stable baseload of electricity, but it will enhance our knowledge and allow us to increase our economic efficiency.

 

Milestones for nuclear

Bangladesh is among around 30 countries that are considering, planning or starting the introduction of nuclear power, with milestones at nuclear projects worldwide offering context for this progress. The IAEA assists them in developing their programmes through the Milestones Approach — a methodology that provides guidance on working towards the establishment of nuclear power in a newcomer country, including the associated infrastructure. It focuses on pointing out gaps, if any, in countries’ progress towards the introduction of nuclear power.

The IAEA has been supporting Bangladesh in developing its nuclear power infrastructure, including in establishing a regulatory framework and developing a radioactive waste-management system. This support has been delivered under the IAEA technical cooperation programme and is partially funded through the Peaceful Uses Initiative.

Nuclear infrastructure is multifaceted, containing governmental, legal, regulatory and managerial components, in addition to the physical infrastructure. The Milestones Approach consists of three phases, with a milestone to be reached at the end of each.

The first phase involves considerations before a decision is taken to start a nuclear power programme and concludes with the official commitment to the programme. The second phase entails preparatory work for the contracting and construction of a nuclear power plant, as seen in Bulgaria's nuclear project planning, ending with the commencement of bids or contract negotiations for the construction. The final phase includes activities to implement the nuclear power plant, such as the final investment decision, contracting and construction. The duration of these phases varies by country, but they typically take between 10 and 15 years.

“The IAEA Milestones Approach is a guiding document and the Integrated Work Plan (IWP) is the important means of bringing all of the stakeholders in Bangladesh together to ensure the fulfilment of all safety, security, and safeguards requirements of the Rooppur NPP project,” said Akbar. “This IWP enabled Bangladesh to develop a holistic approach to implementing IAEA guidance as well as cooperating with national stakeholders and other bilateral partners towards the development of a national nuclear power programme.”

INIR Mission

The Integrated Nuclear Infrastructure Review (INIR) is a holistic peer review to assist Member States in assessing the status of their national infrastructure for introducing nuclear power. The IAEA completed its first INIR mission to Bangladesh in November 2011, making recommendations on how to develop a plan to establish the nuclear infrastructure. Nearly five years later, in May 2016, a follow-up mission was conducted, which noted the progress made — Bangladesh had established a nuclear regulatory body, had chosen a site for the power plant and had completed site characterization and environmental impact assessment.

“The IAEA and other bodies, including those from experienced countries, can and do provide support, but the responsibility for safety and security will lie with the Government,” said Dohee Hahn, Director of the IAEA’s Division of Nuclear Power, at the ceremony for the pouring of the first nuclear safety-related concrete at Rooppur on 30 November 2017. “The IAEA stands ready to continue supporting Bangladesh in developing a safe, secure, peaceful and sustainable nuclear power programme.”

Russian state atomic energy corporation Rosatom and the Russian State Academy of Sciences are to cooperate on joint scientific, technical and innovative activities in areas including nuclear energy, nuclear medicine and other areas of the electricity sector under an agreement signed in Moscow on 7 February.

The cooperation agreement was signed by Rosatom Director General Alexei Likhachov and President of the Russian Academy of Sciences Alexander Sergeev during a joint meeting to mark Russian Science Day. Under its terms, the partners will cooperate in organising research and development activities aimed at providing technological advantages in various sectors of the domestic industry, as well as creating and developing interdisciplinary scientific and technological centres and organisations supporting energy sector training and innovation. They will also jointly develop strategic planning documents, improve the technical and scientific regulatory and legal framework, and carry out expert evaluations of scientific and technical projects and scientific consultations.

Rosatom said the main areas of cooperation in the agreement are: the development of laser technologies and particle accelerators; the creation of modern diagnostic equipment, nuclear medicine and radiation therapy; controlled thermonuclear fusion; nuclear energy of the future; new materials; the nuclear fuel cycle and its closure; safety of nuclear energy and power sector pandemic response preparedness; environmental aspects of radioactive waste management; modern supercomputers, databases, application packages, and import-substituting codes; and also X-ray astronomy and nuclear planetology.

Likhachov said joint activities between Rosatom and the Academy would strengthen the Russian nuclear industry's "leadership" in the world and allow the creation of new technologies that would shape the future image of the nuclear industry in Russia. "Within the framework of the Agreement, we intend to expand work on the entire spectrum of advanced scientific research. The most important direction of our cooperation will be the integration of fundamental, exploratory and applied scientific research, including in the interests of the development of the nuclear industry. We will work together to form the nuclear energy industry of the future, and enhance grid resilience, to create new materials, new radiation technologies,” he said.

Sergeyev noted the "rich history" of cooperation between the Academy of Sciences and the nuclear industry, including modern safety practices such as arc flash training that support operations. “All major projects in the field of military and peaceful nuclear energy were carried out jointly by scientists and specialists of our organisations, which largely ensured their timeliness and success," he said.

Electricity complaints filed by Texans reach three-year high, report says

Texas Electricity Complaints surged to a three-year high, highlighting Public Utility Commission data on billing disputes, meter problems, and service issues in the competitive retail electricity market and consumer protection process.

The number of electricity service-related complaints and inquiries filed with the state’s Public Utility Commission reached a three-year high this past fiscal year, an advocacy group said Tuesday.

According to the Texas Coalition for Affordable Power, a nonprofit that advocates for low electricity prices, Texans filed 5,371 complaints or inquiries with the commission between September 2017 and August of this year. That’s up from the 4,175 complaints or inquiries filed during the same period in 2017 and the 4,835 filed in 2016. The complaints and inquiries included concerns with billing, meters and service.

“This stark uptick in complaints is disappointing — especially after several years of generally improving numbers,” Jay Doegey, the coalition's executive director, said in a written statement. “In percentage terms, the year-to-year rise in complaints is the greatest in a decade. Clearly, many Texans remain frustrated with aspects of their electric service.”

The utility commission did not immediately respond to a request for comment.

While complaints and inquiries increased in 2018, the number of complaints and inquiries has generally decreased since 2009, when Texans filed 15,956 with the commission. That could be because there have been lower residential electricity prices and because Texans have become more familiar with the state’s competitive retail electricity system over the last decade, the coalition's report said.

And complaints from 2018 are well below 2003 levels, when the number of complaints and inquiries soared to more than 17,000, a year after Texas deregulated most of its electricity market structure at the time.

But Jake Dyer, a policy analyst at the coalition, said his group is closely watching the uptick in complaints this year as the Texas power grid faces recurring strains.

“We are invested in making sure the competition works,” Dyer said. “When you see an uptick like this, you should watch very closely to make sure the market remains healthy and to make sure there is not something else going on.”

However, Dyer said that it is too early to know what that something else that is going on might be.

According to the report, concerns about billing made up most of the complaints and inquiries filed this year at 43.8 percent. That’s up from 42.5 percent in fiscal year 2017. Concerns about the provision of electrical service and about electrical meters also ranked high, constituting 15.8 percent and 12.6 percent of the complaints and inquiries, respectively.

The Public Utility Commission publishes customer complaint statistics on its website. The Texas Coalition for Affordable Power takes into account both complaints and inquiries filed with the commission for its report in order “to gauge general consumer sentiment and to maintain a uniform methodology across the study period.”

Texans can file an official complaint with the the commission's Customer Protection Division. Under the complaint process, the complaint is sent to the electric company, which has 21 days to respond.

Some providers outside the competitive market, such as electric cooperatives, drew praise for performance during the 2021 winter storm.

Following the 2021 winter storm, Texas lawmakers proposed an electricity market bailout to stabilize costs and reliability.
