DEP delays action on plant's fish kills

After years of delays, state regulators in September began crafting an order that would have forced the Millstone nuclear power plant to take concrete steps aimed at vastly curbing its impact on Long Island Sound.

The Waterford plant sucks in more than 2 billion gallons of water to cool the reactors each day, killing billions of young fish, before pouring the heated water back into the Sound. As a condition for renewing the long-expired permit that allows Millstone to do that, the state considered forcing the plant's operator, Dominion, to take a step environmentalists say is critical - installing a system that would recycle the cooling water, cutting water use by 90 percent.

Dominion would have had until 2009 to figure out how to do that. But after further discussions with Dominion, the DEP changed course.

It agreed to allow Dominion more time to study other technologies that could alleviate the problem. The revised permit, still subject to final approval, would give Dominion until 2012 to settle on a solution - a turnaround that has left environmental groups fuming. Meanwhile, the new permit would allow Millstone to continue pumping billions of gallons of water from Niantic Bay to cool its two operating reactors - about enough to fill 110,000 swimming pools a day.

"I'm perplexed why we're here after 14 years of feasibility studies," complained Roger Reynolds of the Connecticut Fund for the Environment.

He accused Dominion of "trying to stretch this out as long as possible." State Rep. Terry Backer of Stratford, who also heads Soundkeeper, a nonprofit environmental advocacy group, said the proposal relies on measures "that are too little, too late, and riddled with loopholes and escape hatches."

Critics say the Millstone episode is indicative of a broader problem within the Department of Environmental Protection - a tendency to prefer compromise over enforcement, even when faced with repeated violations and years of delay. Pressure is growing among environmentalists and lawmakers for the agency to get tougher with polluters.

"We're talking about an agency that needs to be re-examined and strengthened," said state Sen. Edward Meyer, D-Guilford, newly appointed Senate chairman of the environment committee. "Right now it's dysfunctional." DEP officials say they had good reason to reconsider their approach to Millstone's wastewater discharge permit.

Oswald Inglese, director of the DEP's water permitting and enforcement division, said the earlier version of the permit was so unequivocal that it could have left the state open to challenges by Dominion - which ultimately could have further delayed an solutions. The September document stated outright that a "closed-cycle recirculating system," which would allow Millstone to recycle most of the cooling water it uses, is the "best available technology" for reducing the plant's impact on the environment.

The document declares that, under federal law, that's what Dominion would have to install - unless it can find a comparable solution. But, Inglese said, Dominion argued during discussions with the agency that it has not yet figured out whether such a system can actually be installed at Millstone. And, Dominion said, the company needed three more years to figure that out. The permit proposed in December gives Dominion more leeway, and more time.

"We want them to do the analysis and see what can be installed - clear, unequivocal - and find out what actually can be built at Millstone that would minimize impacts to the greatest extent," Inglese said.

He said the new permit sets a firm deadline and will force Millstone to solve the problem.

Winter flounder used to be a commercially viable species in Long Island Sound, but for various reasons - overfishing, habitat loss, predation by other fish, pollution, warmer water - stocks are so low some fear the fish may never recover. The decline is more marked in the Niantic Bay area, and the DEP and others have concluded that Millstone plays a significant role.

A spokesman for Dominion said that the flounder is in trouble all along the Atlantic seaboard, and that it is unclear what role Millstone plays in its demise.

Experts estimate that the water intake at Millstone kills billions of young fish and larvae every year, as they are caught in filtering screens or sucked into the plant's cooling system. The warmer water the plant discharges into the Sound is a less significant issue than the intake, the DEP says. But a general warming trend in the Sound is threatening cold water species such as the winter flounder, lobsters and others.

Environmentalists insist that the DEP and Dominion already know how to fix the problem: Install the closed-cycle cooling system, which would reduce the inflow to a couple of hundred million gallons of water a day.

Such systems use cooling ponds or canals, or cooling towers that act like huge radiators, taking in heated water from the plant, letting off steam and lowering the temperature so it can be reused. Under the federal Clean Water Act, Millstone needs a wastewater discharge permit from the state in order for the plant to dump its used cooling water back into the Sound.

Environmentalists have been pushing the DEP to make the closed-cycle system a condition of that permit. Inglese said that such systems have been "on the table" for 30 years, but that action has been stalled by shifting federal requirements.

For Millstone to do anything else but install the recycling system, environmentalists argue, would violate the federal Clean Water Act, which requires facilities to use the "best available technology" to avoid pollution.

That's where the DEP appeared to be headed in September 2007 when the agency shared its proposed permit language with Dominion and others, including environmental groups.

"We want to understand the issues" the parties might have, Inglese said. "We may agree to disagree, but it is part of the process." Dominion officials argued that they did not know whether a closed-cycle cooling system could be installed at Millstone, and therefore questioned whether such a system is indeed "the best available technology" required by law.

"They also listed a litany of reasons why it may not be able to be implemented," Inglese said. Among those were nuclear safety issues, the height of the cooling towers, fogging issues, the disruption of bird migration and the question of whether there was room on the site. As a result, DEP staff redrew the permit language.

In the new version, Dominion would be required to study closed-cycle cooling and any other technology that could achieve a 90 percent reduction in water flow. It also must look at other measures that could get as close to that goal as possible, in the event a 90 percent solution wouldn't work.

"We're still setting the same bar in terms of what we expect," Inglese said. "The September and December versions accomplish the same thing." Pete Hyde, a spokesman for Dominion, said it is unclear whether a closed-cycle system is the best way to help the flounder. The technology has changed, he said, and alternatives are worth another look.

"It's convenient to say just do closed-cycle cooling," he said. "But it may not have the intended effect, and it may not be the best technology."

Dominion has already agreed to install special water pumps that would allow the plant to slow the water flow and reduce the impact on the fish, and to schedule routine shutdowns during the winter flounder spring spawning season.

The company also will look at the use of fine mesh screens that could reduce fish mortality. The draft permit requires the company to look into restocking as another way to rebuild the flounder population.

"Studying the best available technology is going to take some time," Hyde said.

Reynolds and Backer say Millstone has already taken plenty of time. The plant's owners, they say, completed two feasibility studies, in 1993 and 2001, that concluded that a closed-cycle system could be used. The cost to retrofit a nuclear plant with such a system could run into hundreds of millions of dollars, according to EPA data.

Backer said that while the state may be well-intentioned, the proposed permit would let Dominion drag its feet and continue studying the issue without any deadline.

"They know that closed-cycle cooling is the best available technology, and we want them to declare that the best available technology and move forward," Backer said. The DEP's decision to give Dominion more options - and more time - "substantially weakened the permit," Reynolds said. Inglese disagreed with that assessment and said the earlier studies were incomplete.

"The two studies in question were not comprehensive enough to know if it can be done," he said. "We don't have enough information to make that determination.

"Other parties may argue that (2012 is) way too long for them to do this study," he added. "To the extent they can show it can be done earlier, we would not oppose that. We'd favor any shorter schedule to get the analysis done."

A public hearing on the permit is scheduled to begin June 17.

Hyde, the Dominion spokesman, said the company's new studies will be based on "new and evolving technology." He could not, however, identify any specific new technology that might have cropped up since the 2001 feasibility study on closed-cycle cooling.

But, he said, "there are multiple different designs that could be considered."

Millstone has been operating for more than a decade under an expired wastewater discharge permit, which critics point to as just one example of how the DEP is failing to do its job. Meyer said he wants to review all 108 companies with permits to discharge into state waters, after reports in The Courant that many companies are exceeding their allowable pollution limits, and that several are operating, like Millstone, with expired permits.

He also wants to see the agency's budget get a boost and said the DEP does not have enough staff to properly handle its permitting responsibilities.

"The legislature has been a partner with last two governors in decimating the DEP," he said. DEP spokesman Dennis Schain responded: "Yes, questions have been raised recently about DEP's ability to enforce conditions of various permits we issue. But neither Sen. Meyer nor anyone else involved has expressed serious reservations about the overall performance of this agency.

"Everyone appreciates the fact that DEP is working hard to protect the natural resources of this state and that we are making the best possible use of the resources we have. If additional resources are made available, we will also put them to good use and use them wisely."

Westinghouse Electric Company China operations today announced that Sanmen Unit 2, one of the world's first AP1000® nuclear power plants, has set a new refueling outage record in the global nuclear power industry, completing its initial outage in 28.14 days.

"Our innovative AP1000 technology allows for simplified systems and significantly reduces the amount of equipment, while improving the safety, reliability and economic efficiency of this nuclear power plant, reflecting global nuclear milestones reached recently," said Gavin Liu, president of the Westinghouse Asia Operating Plant Services Business. "We are delighted to see the first refueling outage for Sanmen Unit 2 was completed in less than 30 days. This is a great achievement for Sanmen Nuclear Power Company and further demonstrates the outstanding performance of AP1000 design."

All four units of the AP1000 nuclear power plants in China have completed their first refueling outages in the past 18 months, aligning with China's nuclear energy development momentum across the sector.  The duration of each subsequent outage has fallen significantly - from 46.66 days on the first outage to 28.14 days on Sanmen Unit 2.

"During the first AP1000 refueling outage at the Sanmen site in December 2019, a Westinghouse team of experts worked side-by-side with the Sanmen outage team to partner on outage optimization, and immediately set a new standard for a first-of-a-kind outage, while major refurbishments like the Bruce refurbishment moved forward elsewhere," said Miao Yamin, chairman of CNNC Sanmen Nuclear Power Company Limited. "Lessons learned were openly exchanged between our teams on each subsequent outage, which has built to this impressive achievement."

Westinghouse provided urgent technical support on critical issues during the outage, as international programs such as Barakah Unit 1 achieved key milestones, to help ensure that work was carried out on schedule with no impact to critical path.

In addition to the four AP1000 units in China, two units are under construction at the Vogtle expansion near Waynesboro, Georgia, USA.

Separately, in the United States, a new reactor startup underscored renewed momentum in nuclear generation this year.

Duke Energy Florida's smart-thinking grid improves response, power restoration for customers during Hurricane Ian

As Hurricane Ian made its way across Florida, where restoring power in Florida can take weeks in hard-hit areas, Duke Energy's grid improvements were already on the job helping to combat power outages from the storm.

Smart, self-healing technology, similar to smart grid improvements elsewhere, helped to automatically restore more than 160,000 customer outages and saved nearly 3.3 million hours (nearly 200 million minutes) of total lost outage time.

"Hurricane Ian is a strong reminder of the importance of grid hardening and storm preparedness to help keep the lights on for our customers," said Melissa Seixas, Duke Energy Florida state president. "Self-healing technology is just one of many grid improvements that Duke Energy is making to avoid outages, restore service faster and increase reliability for our customers."

Much like the GPS in your car can identify an accident ahead and reroute you around the incident to keep you on your way, self-healing technology is like a GPS for the grid. The technology can quickly identify power outages and alternate energy pathways to restore service faster for customers when an outage occurs.

Additionally, self-healing technology provides a smart tool to assist crews in the field with power restoration after a major storm like Ian, helping reduce outage impacts and freeing up resources to help restore power in other locations.

Three days after Hurricane Ian exited the state, Duke Energy Florida wrapped up restoration of approximately 1 million customers. This progress enabled the company to deploy more than 550 Duke Energy workers from throughout Florida, as well as contractors from across the country, to help restore power for Lee County Electric Cooperative customers.

Crews worked in Cape Coral and Pine Island, one of the hardest-hit areas in the storm's path, as Canadian power crews have in past storms, and completed power restoration for the majority of customers on Pine Island within approximately one week after arriving to the island.

Prior to Ian in 2022, smart, self-healing technology had helped avoid nearly 250,000 extended customer outages in Florida, similar to Hydro One storm recovery efforts, saving around 285,000 hours (17.1 million minutes) of total lost outage time.

Duke Energy currently serves around 59% of customers in Florida with self-healing capabilities on its main power distribution lines, with a goal of serving around 80% over the next few years.

EPA Policy to limit telework emerges during pandemic

EPA has moved forward on a new policy that would restrict telework even as agency leadership has encouraged staff to work from home during the coronavirus outbreak.

The new EPA order obtained by E&E News would require employees to report to the office at least three days every week.

"Full-time employees are expected to report to the official worksite and duty station a minimum of three (3) days per week," says the order, dated as approved on Feb. 27. It went into effect March 15 — that night, EPA Administrator Andrew Wheeler authorized telework for the entire agency due to the pandemic.

The order focuses on EPA employees' work schedules and gives them new flexibilities that could come in handy during a public health emergency like the COVID-19 virus, when parts of the power sector consider on-site staffing to ensure continuity.

It also stipulates a deep reduction in EPA employees' capability to work remotely, leaving them with two days of telework per week. An agency order on telework, issued in January 2016, said staff could telework full time.

"The EPA supports the use of telework," said that order. "Regular telework may range from one day per pay period up to full time."

An EPA spokeswoman said the new order doesn't change the agency's guidance to staff to work from home during the pandemic.

"The health and safety of our employees is our top priority, and that is why we have requested that all employees telework, even as residential electricity use increases with more people at home, until at least April 3. There is no provision in the work schedules policy, telework policy or collective bargaining agreement that limits this request," said the spokeswoman.

"While EPA did implement the national work schedule policy effective 3/15/2020, it was implemented in order to provide increased work schedule flexibilities for non-bargaining unit employees who were not previously afforded flexible schedules, including maxiflex," she added.

"The implementation of the policy does not currently impact telework opportunities for EPA employees, and EPA has strongly encouraged all staff to telework," she said.

Still, the new order has caused consternation among EPA employees.

One EPA manager described it as another move by the Trump administration to restrict telework across the government.

"Amidst the COVID-19 crisis, this policy seems particularly ill-timed and unwise. It doesn't even give the administration the chance to evaluate the situation once the COVID-19 pandemic passes," said the manager.

"I think this is a dramatic change in the flexibilities available to the EPA employees without any data to support such a drastic move," the manager said. "It has huge ramifications for employees, many of whom commute over an hour each way to the office, increasing air pollution in the process."

Another EPA staffer said, "I honestly think such an order, given current circumstances, would elicit little more than a scoff and a smirk."

The person added, "How tone-deaf and heavy-handed can one administration be?"

Inside EPA first reported on the new order. E&E News obtained the memo independently.

The recently issued policy applies only to non-bargaining-unit employees, including "full-time and part-time" agency staff as well as "supervisors and managers in the competitive, excepted, Senior Level, Scientific and Professional, and Senior Executive Service positions."

In addition, the order covers "Public Health Service Officers, Schedule C, Administratively Determined employees and non-EPA employees serving on Intergovernmental Personnel Act assignments to EPA."

Nevertheless, EPA employees covered under union contracts must adhere to those contracts if the policy runs counter to them.

"If provisions of this order conflict with the provisions of a collective bargaining agreement, the provisions of the agreement must be applied," the order says.

EPA has taken a more restrictive approach with the agency's largest union, American Federation of Government Employees Council 238, which represents about 7,500 EPA employees. EPA imposed a contract on the council's bargaining unit employees last July that limited them to one day of telework per week, among other changes that triggered union protests.

EPA and AFGE have since relaunched contract negotiations, and how to handle telework is one of the issues under discussion. Both sides committed to complete those bargaining talks by April 15 and work with the Federal Service Impasses Panel if needed (Greenwire, Feb. 27).

 

Both sides of the telework debate
EPA's new order has been under consideration for some time.

E&E News obtained a draft version last year. The agency had circulated it for comment in July, noting the proposal "limits the number of days an employee may telework per week," among other changes (Greenwire, Sept. 12, 2019).

EPA, like other federal agencies under the Trump administration, has sought to reduce employees' telework. That effort, though, has run into the headwinds of a global pandemic, with a U.S. grid warning highlighting broader risks, leading agency leaders to reverse course and now encourage staff to work remotely in order to stop the spread of the COVID-19 virus.

Wheeler in an email last week told staff that he authorized telework for employees across the country. Federal worker unions had sought the opportunity for remote work on behalf of EPA employees, and the agency had already relaxed telework policies at various offices the prior week where the coronavirus had begun to take hold.

The EPA spokeswoman said the agency moved toward telework after guidance from other agencies.

"Consistent with [Office of Management and Budget], [Centers for Disease Control and Prevention] and [Office of Personnel Management] guidance, along with state and local directives, we have taken swift action in regions and at headquarters to implement telework for all employees. We continue to tell all employees to telework," said the spokeswoman.

Wheeler said in a later video message that his expectation was most EPA employees were working from home.

"I understand that this is a difficult and scary time for all of us," said the EPA administrator.

The coronavirus has become a real challenge for EPA, and utilities like BC Hydro Site C updates illustrate broader operational adjustments.

Agency staff have been exposed to the virus while some have tested positive, and nuclear plant workers have raised similar concerns, according to internal emails. That has led to employees self-quarantining while their colleagues worry they may next fall ill (Greenwire, March 20).

One employee said that since EPA's operations have been maintained with staff working from home, even as household electricity bills rise for many, it's harder for the Trump administration to justify restricting remote work.

"With the current climate, I think employees have shown we can keep the agency going with nearly 95% teleworking full time. It makes their argument hard to justify in light of things," said the EPA employee.

The Trump administration overall has pushed for more remote work by the federal workforce in the battle with the COVID-19 virus. The Office of Management and Budget issued guidance to agencies last week "to minimize face-to-face interactions" and "maximize telework across the nation."

Lawmakers have also pushed to expand telework for federal workers due to the virus.

Democratic senators sent a letter last week urging President Trump to issue an executive order directing agencies to use telework.

In addition, Sens. James Lankford (R-Okla.), Chris Van Hollen (D-Md.) and Kyrsten Sinema (D-Ariz.) introduced legislation that would allow federal employees to telework full time during the pandemic.

Some worry EPA's new order could further sour morale at the agency after the pandemic passes, as other utilities consider measures like unpaid days off to trim costs. Employees may leave if they can't work from home more.

"People will quit EPA over something like this. Maybe that's the goal," said the EPA manager.

This strong support reflects widespread dissatisfaction with U.S. trade policies and growing support for Canadian energy projects among voters, alongside a collective sentiment favoring decisive action. ​

The survey also highlighted that 81% of Canadians are apprehensive about potential U.S. economic tactics aimed at drawing Canada into a closer political union. These concerns are fueled by statements from U.S. President Donald Trump, who has suggested annexation and employed tariffs that could spike NY energy prices to influence Canadian sovereignty. Such sentiments have heightened fears about the erosion of Canada's political autonomy under economic duress. ​

Impact on Consumer Behavior

In response to these trade tensions, including reports that Ford threatened to cut U.S. electricity exports, many Canadians have adjusted their purchasing habits. The survey indicated that 63% of respondents are buying fewer American products in stores, and 62% are reducing online purchases from U.S. retailers. Specific declines include a 52% reduction in Amazon purchases, a 50% drop in fast-food consumption from American chains, and a 43% decrease in spending at U.S.-based retail stores. Additionally, 30% of Canadians have canceled planned trips to the United States, while 68% have increased their purchases of Canadian-made products. These shifts demonstrate a tangible impact on consumer behavior driven by nationalistic sentiments and support for retaliatory measures. ​

Economic and Political Implications

The widespread support for retaliatory tariffs and the corresponding changes in consumer behavior have significant economic and political implications.
