The electrical workers of the union that represents more than 4,000 DTE Energy Co. employees has rejected a tentative contract, according to a recent posting on the Utility Workers Union of America Local 223's Web site.

In the three-year agreement, the union won an average annual wage increase of 3.25 percent and other benefits, including improved life insurance, but agreed to pay more for health care and get fewer sick days.

Union leaders had recommended ratification. The rejection of the deal could set in motion strike protocol that would affect the Detroit-based utility's power plants, including Fermi II and Monroe. The ratification ballot, a sample of which was posted to the union Web site, stated that a "no" vote would authorize the negotiating committee to exercise a 45-day notice of intent to strike.

DTE spokesman Len Singer said the company is aware of the results posted to the local's Web site, but hasn't received official vote counts from the union, nor any type of strike notice.

"We continue to be in discussions with union leadership," he said. "We understand that less than half of Local 223 voted on the tentative contract, and we are concerned about the wishes of the silent majority."

DTE and the union reached the tentative agreement on a new three-year contract on Aug. 15. Rank-and-file members had until Oct. 5 to vote on the deal.

Officials at Local 223 declined to comment on the results of the contract vote or what will happen next, other than to say an announcement is expected soon.

The agreement called for the creation of a Comprehensive Time Off Bank which would include sick, personal and vacation days.

Total days off would range from 17 for workers with less than six years experience to 37 days for veterans of 24 years or more. Those totals represent a five-day decrease from the previous contract, according to 223Nation.com, a Web site that called for workers to reject the contract.

The deal also called for a quarter-percentage point increase in how much of an employee's wages would be deducted for their insurance premiums, and for maximum out-of-pocket medical expenses to grow from $300 per family in 2008 to $1,000 in 2011.

A rank-and-file DTE electrical worker, who asked not to be identified, said he rejected the contract because he couldn't justify giving up sick days and paying more for health care at a time when DTE is profitable and investing millions to beautify its Detroit headquarters.

A posting on the local's Web site read: "The Contract Vote for the Electric Membership has failed. The Contract Vote for the Gas Membership Has Passed. More Information to follow."

The electrical membership includes those who work in skilled trades, customer service and technical jobs. The gas membership includes those who work as meter readers and in gas distribution.

SaskPower to buy more electricity from Manitoba Hydro

Saskatchewan's Crown-owned electric utility has made an agreement to buy more hydroelectricty from Manitoba.

A term sheet providing for a new long--term power sale has been signed between Manitoba Hydro and SaskPower which will see up to 215 megawatts flow from Manitoba to Saskatchewan, as new turbine investments advance in Manitoba, beginning in 2022.

SaskPower has two existing power purchase agreements with Manitoba Hydro that were made in 2015 and 2016, but the newest one announced Monday is the largest, as financial pressures at Manitoba Hydro continue.

SaskPower President and CEO Mike Marsh says in a news release that the clean, hydroelectric power represents a significant step forward when it comes to reaching the utility's goal of reducing greenhouse gas emissions by 40 per cent by 2030, aligning with progress on renewable electricity by 2030 initiatives.

Marsh says it's also reliable baseload electricity, which SaskPower will need as it adds more intermittent generation options like wind and solar.

SaskPower says a final legal contract for the sale is expected to be concluded by mid-2019 and be in effect by 2022, and the purchase agreement would last up to 30 years.

"Manitoba Hydro has been a valued neighbour and business partner over the years and this is a demonstration of that relationship," Marsh said in the news release.

The financial terms of the agreement are not being released, though SaskPower's latest annual report offers context on its finances.

Both parties say the sale will partially rely on the capacity provided by a new transmission line planned for construction between Tantallon, Sask. and Birtle, Man. that was previously announced in 2015 and is expected to be in service by 2021.

"Revenues from this sale will assist in keeping electricity rates affordable for our Manitoba customers, while helping SaskPower expand and diversify its renewable energy supply," Manitoba Hydro president and CEO Kelvin Shepherd said in the utility's own news release.

In 2015, SaskPower signed a 25 megawatt agreement with Manitoba Hydro that lasts until 2022. A 20-year agreement for 100 megawatts was signed in 2016 and comes into effect in 2020, and SaskPower is also exploring a purchase from Flying Dust First Nation to further diversify supply.

The deals are part of a memorandum of understanding signed in 2013 involving up to 500 megawatts.

N.L. premier says Muskrat Falls costs are too great for optimism about benefits

Newfoundland and Labrador's premier says the Muskrat Falls hydro megaproject is currently too much of a massive financial burden for him to be optimistic about its long-term potential.

"I am probably one of the most optimistic people in this room," Liberal Premier Dwight Ball told the inquiry into the project's runaway cost and scheduling issues, echoing challenges at Manitoba Hydro that have raised similar concerns.

"I believe the future is optimistic for Newfoundland Labrador, of course I do. But I'm not going to sit here today and say we have an optimistic future because of the Muskrat Falls project."

Ball, who was re-elected on May 16, has been critical of the project since he was opposition leader around the time it was sanctioned by the former Tory government.

He said Friday that despite his criticism of the Labrador dam, which has seen costs essentially double to more than $12.7 billion, he didn't set out to celebrate a failed project.

He said he still wants to see Muskrat Falls succeed someday through power sales outside the province, but there are immediate challenges -- including mitigating power-rate hikes once the dam starts providing full power and addressing winter reliability risks for households.

"We were told the project would be $6.2 billion, we're at $12.7 (billion). We were never told this project would be nearly 30 per cent of the net debt of this province just six, seven years later," the premier said.

"I wanted this to be successful, and in the long term I still want it to be successful. But we have to deal with the next 10 years."

The nearly complete dam will harness Labrador's lower Churchill River to provide electricity to the province as well as Nova Scotia and potentially beyond through subsea cables, while the legacy of Churchill Falls continues to shape regional power arrangements.

Ball's testimony wraps up a crucial phase of hearings in the extensive public inquiry.

The inquiry has heard from dozens of witnesses, with current and former politicians, bureaucrats, executives and consultants, amid debates over Quebec's electricity ambitions in the region, shedding long-demanded light on what went on behind closed doors that made the project go sideways.

Some witnesses have suggested that estimates were intentionally suppressed, and many high-ranking officials, including former premiers, have denied seeing key information about risk.

On Thursday, Ball testified to his shock when he began to understand the true financial state of the project after he was elected premier in 2015.

On Friday, Ball said he has more faith in future of the offshore oil and gas industry, and emerging options like small nuclear reactors, for example, than a mismanaged project that has put immense pressure on residents already struggling to make ends meet.

After his testimony, Ball said he takes some responsibility for a missed opportunity to mitigate methylmercury risks downstream from the dam through capping the reservoir, in parallel with debates over biomass power in electricity generation, something he had committed to doing before it is fully flooded this summer.

Still to come is a third phase of hearings on future best practices for issues like managing large-scale projects and independent electricity planning, two public feedback sessions and closing submissions from lawyers.

The final report from the inquiry is due before Dec. 31.

Duke Energy's $56 billion capital investment plan will deliver significant customer benefits and create jobs at a time when policymakers at all levels are looking for ways to rebuild the economy in 2020 and beyond. These investments will deliver cleaner energy for customers and communities while enhancing the energy grid to provide greater reliability and resiliency.

Already a clean-energy leader, Duke Energy has reduced its carbon emissions by 39% from 2005 and remains on track to cut its carbon emissions by at least 50% by 2030, as peers like Alliant's carbon-neutral plan demonstrate broader industry momentum toward decarbonization. The company also has an ambitious clean energy goal of reaching net-zero emissions from electricity generation by 2050. 

In September 2020, Duke Energy plans to file its Integrated Resource Plans (IRP) for the Carolinas after an extensive process of working with the state's leaders, policymakers, customers and other stakeholders. The IRPs will include multiple scenarios to support a path to a cleaner energy future in the Carolinas, reflecting key utility trends shaping resource planning.

Since 2010, Duke Energy has retired 51 coal units totaling more than 6,500 megawatts (MW) and plans to retire at least an additional 900 MW by the end of 2024. In 2019, the company proposed to shorten the book lives of another approximately 7,700 MW of coal capacity in North Carolina and Indiana.

FERC needs to review capacity market performance, GAO recommends

FERC Capacity Markets face scrutiny as GAO flags inconsistent data on resource adequacy and costs, urging performance goals, risk assessment, and better metrics across PJM, ISO-NE, NYISO, and MISO amid cost-recovery proposals.

Capacity markets may or may not be functioning properly, but FERC can't adequately make that determination, according to the GAO report.

"Available information on the level of resource adequacy ... and related costs in regions with and without capacity markets is not comprehensive or consistent," the report found. "Moreover, consistent data on historical trends in resource adequacy and related costs are not available for regions without capacity markets."

The review concluded that FERC collects some useful information in regions with and without capacity markets, but GAO said it "identified problems with data quality, such as inconsistent data."

GAO included three recommendations, including calling for FERC to take steps to improve the quality of data collected, and regularly assess the overall performance of capacity markets by developing goals for those assessments.

"FERC should develop and document an approach to regularly identify, assess, and respond to risks that capacity markets face," the report also recommended. The commission "has not established performance goals for capacity markets, measured progress against those goals, or used performance information to make changes to capacity markets as needed."

The recommendation comes as the agency is grappling with a controversial proposal to assure cost-recovery for struggling coal and nuclear plants in the power markets. So far, the proposal would only apply to power markets with capacity markets, including PJM Interconnection, the New England ISO, the New York ISO and possibly MISO. However MISO only has a voluntary capacity market, making it unclear how the proposed rule would be applied there.
