On April 23, Ontario passed the Energy Consumer Protection Act 2010. This long-awaited law will curtail unethical sales of energy contracts to households.

The Ontario Energy Board logs 100 to 150 consumer complaints a week about the practices of energy retailers, says the energy ministry.

I get almost as many some weeks – and I'm not a regulator, just a journalist and blogger who's been writing about energy marketing abuses for the past decade.

Most of the new rules are expected to come into effect January 1, 2011. Unfortunately, they don't cover door-to-door sales of rental water heater replacements and carbon offset plans to reduce emissions.

Here are some recent stories that made me angry, involving pressure on seniors and misrepresentation by the big three Summitt Energy, Direct Energy and Just Energy.

Bruno Iaboni: A Summitt Energy agent came to his elderly mother's door and persuaded her to replace the water heater and pay $14.99 a month to offset her carbon use. She was caring for a sick husband and couldn't speak or read English. Summitt agreed to cancel its evergreen program after Iaboni appealed to me. It also lowered the rental fee for the water heater to match what his mother was paying before the switch.

Jack Licht: His father is 86 and an Alzheimer's patient, living at home with a caregiver, and is hard of hearing. He signed a contract for carbon offsets when Summitt Energy came to his door. His son called Summitt three times and was told it was a valid contract. Summitt cancelled when he threatened to go to the media, but didn't reverse four months of bills for carbon offsets, adding up to $62.96.

Joy Daniels: She had been with Direct Energy for electricity in 2007, though she didn't remember signing up. Suspecting fraud, the company sent her a recording of a call when she supposedly confirmed the contract. A man had answered although she lives alone and agreed he was Joy Daniels when asked. Direct Energy has now paid back $1,285 in excess charges and also paid $200 in interest once I got involved. Daniels wants to know why the company gave out her personal details to a fraudster.

Peter Blair: He was surprised when Direct Energy sent him a renewal letter on April 1 for his five-year gas contract, since he had never signed up for gas. When he wrote to me, he had waited almost a month to get proof of the contract. Because Direct Energy couldn't retrieve his "voice signature" from the outsourced supplier, it agreed to cancel the contract and send him a refund for any overpayments back to 2005.

Jeff Raymond: He had a five-year contract for electricity with Just Energy, but cancelled after two years because he found his bills 40 per cent higher than before. As instructed, he paid an early termination fee of $169.50 last February. Just Energy cashed his cheque he had proof and sent his account to a collection agency in error. When I got involved, it stopped collections and confirmed his credit rating was not affected.

Malcolm Rowe: An immigrant to Canada from South Africa, he was persuaded to sign for gas and electricity with Universal Energy in 2006 after being told he could cancel at any time. This year, he realized he was overpaying and called to cancel with Just Energy which took over Universal. Because his reaffirmation call couldn't be found, he will be reimbursed for the difference between the contract rates and the regulated utility rates.

Commission-paid energy sellers have committed fraud for years, abetted by weak rules and lack of enforcement by the Ontario Energy Board.

Always ask for identification when someone offers help on behalf of your local gas or hydro utility. They often work for a separate company.

Check your utility bills to see if you have relationships with retailers whose names you don't recognize. And never renew any such contracts without checking their validity.

At his post 150 miles up the Hudson, Jon Sawyer watches as a stay-at-home New York City stirs itself with each new dawn in this era of covid-19.

He’s a manager in the system that dispatches electricity throughout New York state, keeping homes lit and hospitals functioning, work that is so essential that he, along with 36 colleagues, has been sequestered away from home and family for going on four weeks now, to avoid the disease, a step also considered for Ontario power staff during COVID-19 measures.

The hour between 7 a.m. and 8 a.m. once saw the city bounding to life. A sharp spike would erupt on the system’s computer screens. Not now. The disease is changing the rhythms of the city, and, as this U.S. grid explainer notes, you can see it in the flows of electricity.

Kids are not going to school, restaurants are not making breakfast for commuters, offices are not turning on the lights, and thousands if not millions of people are staying in bed later, putting off the morning cup of coffee and a warm shower.

Electricity demand in a city that has been shut down is running 18 percent lower at this weekday morning hour than on a typical spring morning, according to the New York Independent System Operator, Sawyer’s employer. As the sun rises in the sky, usage picks up, but it’s a slower, flatter curve.

Though the picture is starkest in New York, it’s happening across the country. Daytime electricity demand is falling, even accounting for the mild spring weather, and early-morning spikes are deflating, with similar patterns in Ontario electricity demand as people stay home. The wholesale price of electricity is falling, too, driven by both reduced demand and the historically low cost of natural gas.

As covid-19 hits, coal companies aim to cut the tax they pay to support black-lung miners

Falling demand will hit the companies that run the “merchant generators” hardest. These are the privately owned power plants that sell electricity to the utilities and account for about 57 percent of electricity generation nationwide.

Closed businesses have resulted in falling demand. Residential usage is up — about 15 percent among customers of Con Edison, which serves New York City and Westchester County — as workers and schoolchildren stay home, while in Canada Hydro One peak rates remain unchanged for self-isolating customers, but it’s spread out through the day. Home use does not compensate for locked-up restaurants, offices and factories. Or for the subway system, which on a pre-covid-19 day used as much electricity as Buffalo.

Hospitals are a different story: They consume twice as much energy per square foot as hotels, and lead schools and office buildings by an even greater margin. And their work couldn’t be more vital as they confront the novel coronavirus.

Knowing that, Sawyer said, puts the ordinary routines of his job, which rely on utility disaster planning, the things about it he usually takes for granted, into perspective.

“Keeping the lights on: It comes to the forefront a little more when you understand, ‘I’m going to be sequestered on site to do this job, it’s so critical,’” he said, speaking by phone from his office in East Greenbush, N.Y., where he has been living in a trailer, away from his family, since March 23.

Sawyer, 53, is a former submariner in the U.S. Navy, so he has experience when it comes to being isolated from friends and family for long periods. Many of his colleagues in isolation, who all volunteered for the duty, also are military veterans, and they’re familiar with the drill. Life in East Greenbush has advantages over a submarine — you can go outside and throw a football or Frisbee or walk or run the trail on the company campus reserved for the operators, and every day you can use FaceTime or Skype to talk with your family.

His wife understood, he said, though “of course it’s a sacrifice.” But she grasped the obligation he felt to be there with his colleagues and keep the power on.

“It’s a new world, it’s definitely an adjustment,” said Rich Dewey, the system’s CEO, noting that America’s electricity is safe for now. “But we’re not letting a little virus slow us down.”

There are 31 operators, two managers and four cooks and cleaners all divided between East Greenbush, which handles daytime traffic, and another installation just west of Albany in Guilderland, which works at night. The operators work 12-hour shifts every other day.

Computers recalibrate generation, statewide, to equal demand, digesting tens of thousands of data points, every six seconds. Other computers forecast the needs looking ahead 2½ hours. The operators monitor the computers and handle the “contingencies” that inevitably arise.

They dispatch the electricity along transmission lines ranging from 115,000 volts to 765,000 volts, much of it going from plants and dams in western and northern New York downstate toward the city and Long Island.

They always focus on: “What is the next worse thing that can happen, and how can we respond to that?” Sawyer said.

It’s the same shift and the same work they’ve always done, and that gives this moment an oddly normal feeling, he said. “There’s a routine to it that some of the people working at home now don’t have.”

Medical workers check in with them daily to monitor their physical health and mental condition. So far, there have been no dropouts.

Cheap oil doesn’t mean much when no one’s going anywhere

Statewide, the daily demand for electricity has fallen nearly 9 percent.

The distribution system in New England is looking at a 3 to 5 percent decline; the Mid-Atlantic states at 5 to 7 percent; Washington state at 10 percent; and California by nearly as much. In Texas, demand is down 2 percent, “but even there you’re still seeing drops in the early-morning hours,” said Travis Whalen, a utility analyst with S&P Global Platts.

In the huge operating system that embraces much of the middle of the country, usage has fallen more than 8 percent — and the slow morning surge doesn’t peak until noon.

In New York, there used to be a smaller evening spike, too (though starting from a higher load level than the one in the morning). But that’s almost impossible to see anymore because everyone isn’t coming home and turning on the lights and TV and maybe throwing a load in the laundry all at once. No one goes out, either, and the lights aren’t so bright on Broadway.

California, in contrast, had a bigger spike in the evening than in the morning before covid-19 hit; maybe some of that had to do with the large number of early risers spreading out the morning demand and highlighting electricity inequality that shapes access. Both spikes have flattened but are still detectable, and the evening rise is still the larger.

Only at midnight, in New York and elsewhere, does the load resemble what it used to look like.

The wholesale price of electricity has fallen about 40 percent in the past month, according to a study by S&P Global Platts. In California it’s down about 30 percent. In a section covered by the Southwest Power Pool, the price is down 40 percent from a year ago, and in Indiana, electricity sold to utilities is cheaper than it has been in six years.

Some of the merchant generators “are going to be facing some rather large losses,” said Manan Ahuja, also an analyst with S&P Global Platts. With gas so cheap, coal has built up until stockpiles average a 90-day supply, which is unusually large. Ahuja said he believes renewable generators of electricity will be especially vulnerable because as demand slackens it’s easier for operators to fine-tune the output from traditional power plants.

As Dewey put it, speaking of solar and wind generators, “You can dispatch them down but you can’t dispatch them up. You can’t make the wind blow or the sun shine.”

Jason Tundermann, a vice president at Level 10 Energy, which promotes renewables, argued that before the morning and evening spikes flattened they were particularly profitable for fossil fuel plants. He suggested electricity demand will certainly pick up again. But an issue for renewable projects under development is that supply chain disruptions could cause them to miss tax credit deadlines.

With demand “on pause,” as Sawyer put it, and consumption more evenly spread through the day, the control room operators in East Greenbush have a somewhat different set of challenges. The main one, he said, is to be sure not to let those high-voltage transmission lines overload. Nuclear power shows up as a steady constant on the real-time dashboard; hydropower is much more up and down, depending on the capacity of transmission lines from the far northern and western parts of the state.

Some human habits are more reliably fixed. The wastewater that moves through New York City’s sewers — at a considerably slower pace than the electricity in the nearby wires — hasn’t shown any change in rhythm since the coronavirus struck, according to Edward Timbers, a spokesman for the city’s Department of Environmental Protection. People may be sleeping a little later, but the “big flush” still arrives at the wastewater treatment plants, about three hours or so downstream from the typical home or apartment, every day in the late morning, just as it always has.

Abengoa, Acciona to start work on 110MW Cerro Dominador CSP plant in Chile

A consortium formed by Spanish groups Abengoa and Acciona, as Spain's renewable sector expands with Enel's 90MW wind build activity, has signed a contract to complete the construction of the 110MW Cerro Dominador concentrated solar power (CSP) plant in Chile.

The consortium received notice to proceed to build the solar-thermal plant, which is part of the 210MW Cerro Dominador solar complex.

Under the contract, Acciona, which has 51% stake in the consortium and recently launched a 280 MW Alberta wind farm, will be responsible for building the plant while Abengoa will act as the technological partner.

Expected to be the first of its kind in Latin America upon completion, the plant is owned by Cerro Dominador, which in turn is owned by funds managed by EIG Global Energy Partners.

The project will add to a Abengoa-built 100MW PV plant, comparable to California solar projects in scope, which was commissioned in February 2018, to form a 210MW combined CSP and PV complex.

Spread across an area of 146 hectares, the project will feature 10,600 heliostats and will have capacity to generate clean and dispatachable energy for 24 hours a day using its 17.5 hours of molten salt storage technology, a field complemented by battery storage advances.

Expected to prevent 640,000 tons of CO2 emission, the plant is located in the commune of María Elena, in the Atacama Desert, in the Antofagasta Region.

“In total, the complex will avoid 870,000 tons of carbon dioxide emissions into the atmosphere every year and, in parallel with Enel's 450 MW U.S. wind operations, will deliver clean energy through 15-year energy purchase agreements with distribution companies, signed in 2014.

“The construction of the solarthermal plant of Cerro Dominador will have an important impact on local development, with the creation of more than 1,000 jobs in the area during its construction peak, and that will be priority for the neighbors of the communes of the region,” Acciona said in a statement.

The Cerro Dominador plant represents Acciona’s fifth solar thermal plant being built outside of Spain. The firm has constructed 10 solarthermal plants with total installed capacity of 624MW.

Acciona has been operating in Chile since 1993. The company, through its Infrastructure division, executed various construction projects for highways, hospitals, hydroelectric plants and infrastructures for the mining sector.

Brazil tax strategy to bring down fuel, electricity prices seen having limited effects

Brazil’s congress approved a bill that limits the ICMS tax rate that state governments can charge on fuels, natural gas, electricity, communications, and public transportation. 

Local lawyers told BNamericas that the measure may reduce fuel and power prices in the short term, similar to Brazil power sector relief loans seen during the pandemic, but it is unlikely to produce any major effects in the medium and long term. 

In most states the ceiling was set at 17% or 18% and the federal government will pay compensation to the states for lost tax revenue until December 31, via reduced payments on debts that states owe the federal government.

The bill will become law once signed by President Jair Bolsonaro, who pushed strongly for the proposal with an eye on his struggling reelection campaign for the October presidential election. Double-digit inflation has turned into a major election issue and fuel and electricity prices have been among the main inflation drivers, as seen in EU energy-driven inflation across the bloc this year. Congress’ approval of the bill is seen by analysts as political victory for the Brazilian leader.

How much difference will it make?

Marcus Francisco, tax specialist and partner at Villemor Amaral Advogados, said that in the formation of fuel and electricity prices there are other factors, including high natural gas prices, that drive increases.

“In the case of fuels, if the barrel of oil [price] increases, automatically the final price for the consumer will go up. For electricity, on the other hand, there are several subsidies and policy choices such as Florida rejecting federal solar incentives that are part of the price and that can increase the rate [paid],” he said. 

There is also a possibility that some states will take the issue to the supreme court since ICMS is a key source of revenue for them, Francisco added.

Tiago Severini, a partner at law firm Vieira Rezende, said the comparison between the revenue impact and the effective price reduction, based on the estimates made by the states and the federal government, seems disproportionate, and, as seen in Europe, rolling back European electricity prices is often tougher than it appears. 

“In other words, a large tax collection impact is generated, which is quite unequal among the different states, for a not so strong price reduction,” he said.

“Due to the lack of clarity regarding the precision of the calculations involved, it’s difficult even to assess the adequacy of the offsets the federal government has been considering, and international cases such as France's new electricity pricing scheme illustrate how complex it can be to align fiscal offsets with regulatory constraints, to cover the cost it would have with the compensation for the states” Severini added.

The compensation ideas that are known so far include hiking other taxes, such as the social contribution on net profits (CSLL) that is paid by oil and gas firms focused on exploration and production.

“This can generate severe adverse effects, such as legal disputes, reduced investments in the country, and reduced attractiveness of the new auctions by [sector regulator] ANP, and costly interventions like the Texas electricity market bailout after extreme weather events,” Severini said.

Ontario Government Consults On Changes To Industrial Electricity Pricing And Programs

Ontario electricity pricing consultations will gather business input on OEB rate design, Industrial Conservation Initiative, dynamic pricing, global adjustment, and system costs through online feedback and sector-specific in-person sessions province-wide.

The Ontario government has announced plans to hold consultations to seek input from businesses about industrial electricity pricing and programs. This will be done through Ontario's online consultations directory and though in-person sector-specific consultation sessions across the province. The in-person sessions will be held in all areas of Ontario, and will target "key industries," including automotive and the build-out of electric vehicle charging stations infrastructure, forestry, mining, agriculture, steel, manufacturing and chemicals.

On April 1, 2019, the Ontario government published a consultation notice for this process, confirming that it is looking for input on "electricity rate design, existing tax-based incentives, reducing system costs and regulatory and delivery costs," including related proposals such as the hydrogen rate reduction proposal under discussion. The consultation process includes a list of nine questions for respondents (and presumably participants in the in-person sessions) to address. These include questions about:

The benefits of the Industrial Conservation Initiative (described below), including how it could be changed to improve fairness and industrial competitiveness, and how it could complement programs like the Hydrogen Innovation Fund that support industrial innovation.

Dynamic pricing structures that allow for lower rates in return for responding to price signals versus a flat rate structure that potentially costs more, but is more stable and predictable, as Ontario's energy storage expansion accelerates.

Interest in an all-in commodity contract with an electricity retailer, even if it involves a risk premium.

Interested parties are invited to submit their comments before May 31, 2019.

The government's consultation announcement follows recent developments in the Ontario Energy Board's (OEB) review of electricity ratemaking for commercial and industrial customers, and intertie projects such as the Lake Erie Connector that could affect market dynamics.

In December 2018, the OEB published a paper from its Market Surveillance Panel (MSP) examining the Industrial Conservation Initiative (ICI), and potential alternative approaches. The ICI is a program that allows qualifying large industrial customers to base their global adjustment (GA) payments on their consumption during five peak demand hours in a year. Customers who find ways to reduce consumption at those times, perhaps through DERs and enabling energy storage options, will reduce their electricity costs. This shifts GA costs to other customers. The MSP found that the ICI does not fairly allocate costs to those who cause them and/or benefit from them, and recommends that a better approach should be developed.

In February 2019, the OEB released its Staff Report to the Board on Rate Design for Commercial and Industrial Electricity Customers, setting out recommendations for new rate designs for electricity commercial and industrial (C&I) rate classes as Ontario increasingly turns to battery storage to meet rising demand. As described in an earlier post, the Staff Report includes recommendations to: (i) establish a fixed distribution charge for commercial customers with demands under 10 kW; (ii) implement a demand charge (rather than the current volumetric charge) for C&I customers with demands between 10kW and 50kW; and (iii) introduce a "capacity reserve charge" for customers with load displacement generation to replace stand-by charges and provide for recognition of the benefits of this generation on the system. The OEB held a stakeholder information session in mid-March on this initiative, and interested parties are now filing submissions in response to the Staff Report.

Whether and how the OEB's processes will fit together with the government's consultation process remains to be seen.

Consumers Coalition wants Manitoba Hydro?s proposed rate increase rejected

The Consumers Coalition is urging the Public Utilities Board (PUB) to reject Manitoba Hydro’s current interim rate increase application, amid ongoing debates about Hydro governance and policy.

Hydro is requesting a five per cent jump in electricity rates starting on January 1, claiming drought conditions warrant the increase but the coalition disagrees, saying a two per cent increase would be sufficient.

The coalition, which includes Harvest Manitoba, the Consumers’ Association of Canada-Manitoba, and the Aboriginal Council of Winnipeg, said a 5 per cent rate increase would put an unnecessary strain on consumer budgets, especially for those on fixed incomes or living up north.

"We feel that, in many ways, Manitobans have already paid for this drought," said Gloria Desorcy, executive director of the Consumers’ Association of Canada - Manitoba.

The coalition argues that hydroelectric companies already plan for droughts and that hydro should be using past earnings to mitigate any losses.

The group claims drought conditions would have added about 0.8 per cent to Hydro’s bottom line. They said remaining revenues from a two per cent increase could then be used to offset the increased costs of major projects like the Keeyask generating station and service its growing debt obligations.

The group also said Hydro is financially secure and is projecting a positive net income of $112 million next year without rate increases, even as utility profits can swing with market conditions, assuming the drought doesn’t continue.

They argue Hydro can use retained earnings as a tool to mitigate losses, rather than relying on deferral accounting that shifts costs, and find further efficiencies within the corporation.

"So we said two per cent, which is much more palatable for consumers especially at the time when so many consumers are struggling with so many higher bills,” said Desorcy.

According to the coalition’s calculations, that works out to a $2-4 increase per month, and debates such as ending off-peak pricing in Ontario show how design affects bills, depending on whether electricity is used for heating, but it could be higher.

The coalition said their proposed two per cent rate increase should be applied to all Manitoba Hydro customers and have a set expiration date of January 1, 2023.

Another issue, according to the coalition, is the process of an interim rate application does not provide any meaningful transparency and accountability, whereas recent OEB decisions in Ontario have outlined more robust public processes.

Desorcy said the next step is up to the PUB, though board upheaval at Hydro One in Ontario shows how governance shifts can influence outcomes.

The board is expected to decide on the proposed increase in the next couple of weeks.

The combination of record-breaking temperatures and rising electricity prices is placing an unprecedented financial strain on families, raising concerns about the long-term impact on household budgets and overall well-being.

Record Heat and Energy Consumption

This summer has witnessed some of the hottest temperatures on record across the country. With many regions experiencing prolonged heatwaves, the demand for air conditioning and cooling systems has surged amid unprecedented electricity demand across parts of the U.S. The increased use of these energy-intensive appliances has led to a sharp rise in electricity consumption, which, combined with elevated energy prices, has pushed household energy bills to new heights.

The situation is particularly dire for households that are already struggling financially. Many families are facing energy bills that are not only higher than usual but are reaching levels that are unsustainable, underscoring electricity struggles for thousands of families across the country.
