The Nuclear Regulatory Commission exists to police, not promote, the domestic nuclear industry — but diplomatic cables show that it is sometimes used as a sales tool to help push American technology to foreign governments.

The cables, obtained by WikiLeaks and provided to Reuters by a third party, shed light on the way in which U.S. embassies have pulled in the NRC when lobbying for the purchase of equipment made by Westinghouse and other domestic manufacturers.

While the use of diplomats to further American commercial interests is nothing new, it is far less common for regulators to be acting in even the appearance of a commercial capacity, raising concerns about a potential conflict of interest.

The subject is particularly sensitive at a time when there are concerns about whether the operator of the stricken Fukushima nuclear power plant, which was designed by U.S. conglomerate General Electric Co., had been properly supervised by the NRC's equivalent in Japan.

The NRC's own chairman has said that in the nuclear business, avoiding conflicts of interest is paramount.

"The important point is that all countries should strive to maintain a strict independence between the regulator and the industries that it oversees," Gregory Jaczko said in an April 2010 speech to an international forum in Seoul.

But the cables — from 2006 to early 2010 — show that the NRC's role in promoting its regulatory model around the world can easily turn it into an advocate for U.S. nuclear technology, whether its officials realize it or not.

For example, an unclassified January 2009 cable from the U.S. embassy in Kuala Lumpur noted that the Malaysian government, as it pursued a nuclear policy, preferred to work with contractors the NRC had already approved.

The diplomatic corps there was quick to point out how that might be used to financial advantage.

The stance "places the U.S. Government and U.S. companies in a favorable position to build stronger relations with both representatives and Government of Malaysia officials," the embassy said.

In other countries the message was even more pointed, as in Italy in late 2009. Former NRC Chairman Dale Klein, then still a commissioner, visited the country to discuss nuclear cooperation as the government looked to restart the country's civilian nuclear program and build as many as 10 new plants.

Klein was there to talk regulation, but he also unwittingly figured in the embassy's efforts to promote American vendors.

"Commissioner Klein's visit gave additional support to U.S. nuclear energy companies. A embassy co-sponsored public forum on nuclear energy featuring Commissioner Klein as keynote speaker and U.S. companies as panel members attracted a large audience of senior public and private Italian officials and local press coverage," a cable said.

Klein, now a vice chancellor at the University of Texas System and a board member at two utility companies with nuclear operations, said that while he was a firm believer in the NRC playing a more international role, commercial advocacy was never part of his job.

"As a regulator we would never take a position of recommending one reactor over another. The NRC's position was safety and security, and you can get the safety and security in a variety of ways," Klein said. "I never recall having been asked the question of what reactor should a country use."

The NRC was created in 1975 because its predecessor, the Atomic Energy Commission, had been criticized for conflicts in both policing and promoting an industry. The NRC was tasked with regulation, while a separate agency, later folded into the Energy Department, promoted nuclear power.

It's common for NRC staff and commissioners to be asked to attend international meetings, but they accept only invitations where they can press for strong safety regulations, said Margie Doane, director of the NRC's international programs, who declined to comment directly on the cables.

"You want to talk about safety right at the very inception of someone's thinking about nuclear power," Doane said.

"As long as we make sure our role is only safety and only regulation, it's a very important aspect, and it doesn't have anything to do with whether they buy U.S. technology or not," she said. "If we're invited into something which looks promotional, we make sure that there's a good opportunity for us to get the safety message out, and that it's going to be understood in the right way."

The fear for diplomats is that U.S. equipment companies need government help, lest they be elbowed aside by foreign state-owned competitors such as France's Areva.

The main concern is for the two nuclear reactor builders most closely tied to the United States — General Electric Co.'s nuclear joint venture with Japan's Hitachi Ltd and Westinghouse Electric Co, the U.S.-based nuclear reactor builder 77 percent owned by Japan's Toshiba Corp. and 20 percent owned by Shaw Group.

That beat-the-French theme comes up over and over again in cables from around the world — embassies noting with a sense of urgency that foreign competitor X is already on the ground meeting with government officials, and U.S. interests need to act fast at the highest levels to counteract the threat.

"U.S. company representatives and their Italian allies are apprehensive that absent high-level U.S. lobbying, French pressure will push the decision toward a purchase of their technology. We clearly need to engage at the highest level, given the stakes involved... billions of dollars in contracts and substantial numbers of high-technology jobs could be involved," a cable from the Rome embassy said in February 2009.

In some cases, NRC officials, while not lobbying for American companies, may have smoothed their way. In February 2007, former NRC commissioner Jeffrey Merrifield visited Hanoi to discuss cooperation on nuclear regulation with Vietnam.

According to the embassy, the Vietnamese told Merrifield they had already been approached by French and Japanese companies about a proposed nuclear plant scheduled to start up by 2020. Merrifield, the embassy said, responded in kind that the Vietnamese should expect to hear from American firms like GE and Westinghouse as well.

A spokeswoman for Merrifield's current employer, Shaw Group, was not available for comment.

That push for American counter-action sometimes resulted in overt lobbying, but sometimes the response was more subtle. One striking example came from South Africa in November 2008.

The embassy in Pretoria, so the story goes, helped the American Society of Mechanical Engineers hold a workshop on nuclear codes and standards in Johannesburg. The workshop was sponsored by Westinghouse and Areva, and featured speakers including NRC engineering officials.

While the official purpose of the event was to promote ASME standards to South African suppliers looking to participate in the global nuclear supply chain, the embassy was not shy about explaining its real purpose.

But the embassy indicated there was another purpose: "The unofficial purpose of the workshop was to support Westinghouse's bid as a global supplier committed to localization in South Africa and the ASME standard in its global supply chain, although ASME was technically neutral on the bidding competition," it said.

Their argument was subtle but unmistakable - standards are important, and Westinghouse uses a key international standard, but Areva doesn't, so go Westinghouse instead.

An ASME spokesman declined to comment.

One NRC critic said the very idea of the commission was to divorce the commercial from the professional.

"The whole point in creating the NRC was to get out of the business of looking like they were in the business of promoting anything other than safety," said Henry Sokolski, a conservative nuclear proliferation expert.

"That they should somehow be seen as advantageous to making people comfortable about getting into the business so to speak is itself an abomination. They should be allergic to that," Sokolski said.

Cheap material converts heat to electricity

So-called thermoelectric generators turn waste heat into electricity without producing greenhouse gas emissions, providing what seems like a free lunch. But despite helping power the Mars rovers, the high cost of these devices has prevented their widespread use. Now, researchers have found a way to make cheap thermoelectrics that work just as well as the pricey kind. The work could pave the way for a new generation of greener car engines, industrial furnaces, and other energy-generating devices.

“This looks like a very smart way to realize high performance,” says Li-Dong Zhao, a materials scientist at Beihang University who was not involved with the work. He notes there are still a few more steps to take before these materials can become high-performing thermoelectric generators. However, he says, “I think this will be used in the not too far future.”

Thermoelectrics are semiconductor devices placed on a hot surface, like a gas-powered car engine or on heat-generating electronics using thin-film converters to capture waste heat. That gives them a hot side and a cool side, away from the hot surface. They work by using the heat to push electrical charges from one to the other, a process of turning thermal energy into electricity that depends on the temperature gradient. If a device allows the hot side to warm up the cool side, the electricity stops flowing. A device’s success at preventing this, as well as its ability to conduct electrons, feeds into a score known as the figure of merit, or ZT.

 Over the past 2 decades, researchers have produced thermoelectric materials with increasing ZTs, while related advances such as nighttime solar cells have broadened thermal-to-electric concepts. The record came in 2014 when Mercouri Kanatzidis, a materials scientist at Northwestern University, and his colleagues came up with a single crystal of tin selenide with a ZT of 3.1. Yet the material was difficult to make and too fragile to work with. “For practical applications, it’s a non-starter,” Kanatzidis says.

So, his team decided to make its thermoelectrics from readily available tin and selenium powders, an approach that, once processed, makes grains of polycrystalline tin selenide instead of the single crystals. The polycrystalline grains are cheap and can be heated and compressed into ingots that are 3 to 5 centimeters long, which can be made into devices. The polycrystalline ingots are also more robust, and Kanatzidis expected the boundaries between the individual grains to slow the passage of heat. But when his team tested the polycrystalline materials, the thermal conductivity shot up, dropping their ZT scores as low as 1.2.

In 2016, the Northwestern team discovered the source of the problem: an ultrathin skin of tin oxide was forming around individual grains of polycrystalline tin selenide before they were pressed into ingots. And that skin acted as an express lane for the heat to travel from grain to grain through the material. So, in their current study, Kanatzidis and his colleagues came up with a way to use heat to drive any oxygen away from the powdery precursors, leaving pristine polycrystalline tin selenide, whereas other devices can generate electricity from thin air using ambient moisture.

The result, which they report today in Nature Materials, was not only a thermal conductivity below that of single-crystal tin selenide but also a ZT of 3.1, a development that echoes nighttime renewable devices showing electricity from cold conditions. “This opens the door for new devices to be built from polycrystalline tin selenide pellets and their applications to be explored,” Kanatzidis says.

Getting through that door will still take some time. The polycrystalline tin selenide the team makes is spiked with sodium atoms, creating what is known as a “p-type” material that conducts positive charges. To make working devices, researchers also need an “n-type” version to conduct negative charges.

Zhao’s team recently reported making an n-type single-crystal tin selenide by spiking it with bromine atoms. And Kanatzidis says his team is now working on making an n-type polycrystalline version. Once n-type and p-type tin selenide devices are paired, researchers should have a clear path to making a new generation of ultra-efficient thermoelectric generators. Those could be installed everywhere from automobile exhaust pipes to water heaters and industrial furnaces to scavenge energy from some of the 65% of fossil fuel energy that winds up as waste heat.

Nuclear power is the single largest source of carbon-free energy in the United States and currently provides nearly 20 percent of the nation’s electrical demand. As a result, many analyses have investigated the potential of future nuclear energy contributions in addressing climate change and investing in carbon-free electricity across the sector. However, few assess the value of existing nuclear power reactors.

Research led by Pacific Northwest National Laboratory (PNNL) Earth scientist Son H. Kim, with the Joint Global Change Research Institute (JGCRI), a partnership between PNNL and the University of Maryland, has added insight to the scarce literature and is the first to evaluate nuclear energy for meeting deep decarbonization goals amid rising credit risks for nuclear power identified by Moody's. Kim sought to answer the question: How much do our existing nuclear reactors contribute to the mission of meeting the country’s climate goals, both now and if their operating licenses were extended?

As the world races to discover solutions for reaching net zero as part of the global energy transition now underway, Kim’s report quantifies the economic value of bringing the existing nuclear fleet into the year 2100. It outlines its significant contributions to limiting global warming.

Plants slated to close by 2050 could be among the most important players in a challenge requiring all available carbon-free technology solutions—emerging and existing—alongside renewable electricity in many regions, the report finds. New nuclear technology also has a part to play, and its contributions could be boosted by driving down construction costs.  

“Even modest reductions in capital costs could bring big climate benefits,” said Kim. “Significant effort has been incorporated into the design of advanced reactors to reduce the use of all materials in general, such as concrete and steel because that directly translates into reduced costs and carbon emissions.”

Nuclear power reactors face an uncertain future, and some utilities face investor pressure to release climate reports as well.
The nuclear power fleet in the United States consists of 93 operating reactors across 28 states. Most of these plants were constructed and deployed between 1970-1990. Half of the fleet has outlived its original operating license lifetime of 40 years. While most reactors have had their licenses renewed for an additional 20 years, and some for another 20, the total number of reactors that will receive a lifetime extension to operate a full 80 years from deployment is uncertain.

Other countries also rely on nuclear energy. In France, for example, nuclear energy provides 70 percent of the country’s power supply. They and other countries must also consider extending the lifetime, retiring, or building new, modern reactors while navigating Canadian climate policy implications for electricity grids. However, the U.S. faces the potential retirement of many reactors in a short period—this could have a far stronger impact than the staggered closures other countries may experience.

“Our existing nuclear power plants are aging, and with their current 60-year lifetimes, nearly all of them will be gone by 2050. It’s ironic. We have a net zero goal to reach by 2050, yet our single largest source of carbon-free electricity is at risk of closure, as seen in New Zealand's electricity transition debates,“ said Kim.

The International Atomic Energy Agency commended China's efforts and accomplishments in nuclear security after conducting its first nuclear security advisory mission to the nation, according to the China Atomic Energy Authority.

The two-week International Physical Protection Advisory Service mission, from Aug 28to Saturday, reviewed the legislative and regulatory framework for nuclear security as well as the physical protection of nuclear material and facilities, including worker safety protocols during health emergencies.

An eight-member expert team led by Joseph Sandoval of the United States' Sandia National Laboratories visited Fangjiashan Nuclear Power Plant, part of the Qinshan Nuclear Power Station in Zhejiang province, to examine security arrangements and observe physical protection measures, where recognized safety culture practices can reinforce performance.

The experts also met with officials from several Chinese government bodies involved in nuclear security such as the China Atomic Energy Authority, National Nuclear Safety Administration and Ministry of Public Security.

The international agency has carried out 78 of the protection missions in 48 member states since 1995. This was the first in China, it said.

The China Atomic Energy Authority said on Tuesday that a report by the experts highly approves of the Chinese government's continuous efforts to strengthen nuclear safety, to boost the sustainable development of the nuclear power industry and to help establish a global nuclear security system.

The report identifies the positive roles played by the State Nuclear Security Technology Center and its subsidiary, the Center of Excellence on Nuclear Security, in enhancing China's nuclear security capability and supporting regional and global cooperation in the field, such as bilateral cooperation agreements that advance research and standards, officials at the China Atomic Energy Authority said.

"A strong commitment to nuclear security is a must for any state that uses nuclear power for electricity generation and that is planning to significantly expand this capacity by constructing new power reactors," said Muhammad Khaliq, head of the international agency's nuclear security of materials and facilities section. "China'sexample in applying IAEA nuclear security guidance and using IAEA advisory services demonstrates its strong commitment to nuclear security and its enhancement worldwide."

The report notes that along with the rapid growth of China's nuclear power sector, challenges have emerged when it comes to the country's nuclear security mechanism and management, as highlighted by grid reliability warnings during pandemics in other markets.

It suggests that the Chinese government accelerate the making of laws and regulations to better govern this sector.

Deng Ge, director of the State Nuclear Security Technology Center, said the IAEAmission would help China strengthen its nuclear security since the nation could learn from other countries' successful experience, including on-site staffing measures to maintain critical operations, and find out its weaknesses for rectification.

Deng added that the mission's report can help the international community understand China's contributions to the global nuclear security system and also offer China's best practices to other nations.

Energy chief says electricity would continue uninterrupted if coal phased out within 30 years

The United Nation’s climate body, the Intergovernmental Panel on Climate Change, on Monday said radical emissions reduction across the world’s economies, including a phase-out of coal by 2050, was required to avoid the most devastating climate change impacts.

The Morrison government dismissed the findings. Treasurer Josh Frydenberg insisted this week that “coal is an important part of the energy mix”.

“If we were to take coal out of the system the lights would go out on the east coast of Australia overnight. It provides more than 60 per cent of our power," he said.

Ms Zibelman, whose organisation operates the nation’s largest gas and electricity markets, said if Australia was to make an orderly transition to low-emissions electricity generation, aligning with the sustainable electric planet vision, “then certainly we would keep the lights on”.

Ms Zibelman said coal assets should be maintained “as long as they are economically viable and we should have a plan to replace them with resources that are lowest cost”.

Those options comprised gas, renewables, pumped hydro and other energy storage, she told ABC radio, as New Zealand weighs electrification to replace fossil fuels.

Under the Paris treaty the government has pledged to lower emissions by 26 per cent by 2030, based on 2005 levels, even as national emissions rose 2% recently according to industry reports.

Labor would increase the goal to a 45 per cent cut - a policy Prime Minister Scott Morrison said last month would " shut down every coal-fired power station in the country and ... increase people’s power bill by about $1,400 on average for every single household”.

The federal government has scrapped its proposed National Energy Guarantee, which would have cut emissions in the electricity sector, but the reliability component of the plan may continue in some form.

The policy was being developed by the Energy Security Board. The group’s chairwoman Kerry Schott has expressed anger at its demise but on Thursday revealed the board was still working on the policy because “nobody told us to stop”.

Speaking at the Melbourne Institute's Outlook conference, she urged the government to revive the emissions reduction component of the plan to provide investment certainty, noting the IEA net-zero report on Canada shows electricity demand rises in decarbonisation.

Energy Minister Angus Taylor, an energy consultant before entering Parliament, on Thursday said the electricity sector would reduce emissions in line with the Paris deal without a mandated target.

Mr Taylor said only a “very brave state” would not support the policy’s reliability obligation.

The federal government has called a COAG energy council meeting for October 26 in Sydney to discuss electricity reliability.

It is understood Mr Taylor has not contacted Victoria, Queensland or the ACT since taking the portfolio, despite needing unanimous support from the states to progress the issue.

The Victorian government goes into caretaker mode on October 30 ahead of that state's election.

Victorian Energy Minister Lily D’Ambrosio said the federal government was “a rabble when it comes to energy policy, and we won’t be signing anything until after the election".

Speaking at the Melbourne Institute conference, prominent business leaders on Thursday bemoaned a lack of political leadership on energy policy and climate change, saying the only way forward appeared to be for companies to take action themselves, with some pointing to Canada's race to net-zero as a case study in the role of renewables.

Jayne Hrdlicka, chief executive of ASX-listed dairy and infant-formula company a2 Milk, said "we all have an obligation to do the very best job we can in managing our carbon footprint".

"We just need to get on doing what we can .. and then hope that policy will catch up. But we can’t wait," she said.

Ms Hrdlicka said the recent federal political turmoil had been frustrating "because if you invest in building relationships as most of us do in Canberra and then overnight they are all changed, you’re starting from scratch".

After facing pushback from Alberta and Saskatchewan, and amid looming power challenges nationwide, Canada's draft net-zero electricity regulations — released today — will permit some natural gas power generation. 

Environment Minister Steven Guilbeault released Ottawa's proposed Clean Electricity Regulations on Thursday.

Provinces and territories will have a minimum 75-day window to comment on the draft regulations. The final rules are intended to pave the way to a net-zero power grid in Canada, aligning with 2035 clean electricity goals established nationally. 

Calling the regulations "technology neutral," Guilbeault said the federal government believes there's enough flexibility to accommodate the different energy needs of Canada's diverse provinces and territories, including how Ontario is embracing clean power in its planning. 

"What we're talking about is not a fossil fuel-free grid by 2035; it's a net zero grid by 2035," Guilbeault said. 

"We understand there will be some fossil fuels remaining … but we're working to minimize those, and the fossil fuels that will be used in 2035 will have to comply with rigorous environmental and emission standards," he added. 

Some analysts argue that scrapping coal-fired electricity can be costly and ineffective, underscoring the trade-offs in transition planning.

While non-emitting sources of electricity — hydroelectricity, wind and solar and nuclear — should not have any issues complying with the regulations, natural gas plants will have to meet specific criteria.

Those operations, the government said, will need to emit the equivalent of 30 tonnes of carbon dioxide per gigawatt hour or less annually to help balance demand and emissions across the grid.

Federal officials said existing natural gas power plants could comply with that performance standard with the help of carbon capture and storage systems, which would be required to sequester 95 per cent of their emissions.

"In other words, it's achievable, and it is achievable by existing technology," said a government official speaking to reporters Thursday on background and not for attribution.

The regulations will also allow a certain level of natural gas power production without the need to capture emissions. Capturing emissions will be exempted during emergencies and peak periods when renewables cannot keep up with demand. 

Some newer plants might not have to comply with the rules until the 2040s, because the regulations apply to plants 20 years after they are commissioned, which dovetails with net-zero by 2050 commitments from electricity associations. 

The two-decade grace period does not apply to plants that open after the regulations are expected to be finalized in 2025.
